*:/ : 11-1 h WA <br />Raiff Street Site <br />The Raitt Street Site is vacant with seven trees and no native vegetation suitable to provide habitat for sensitive <br />or special status species. There is no riparian habitat on of near the site. The site has been previously disturbed <br />and surrounded by various urban development. No endangered, fare, threatened, of special status plant of <br />wildlife species designated by the USFWS, CDFW, of CNPS are known to occur on this site. No known regional <br />wildlife corridofs of any other sensitive biological areas as indicated by the USFWS Critical Habitat portal of <br />CDFW BIOS (USFWS 2018, CDFW 2018). <br />b) Have a substantial adverse effect on any riparian habitat or other sensitive natural community <br />identified in local or regional plans, policies, regulations, or by the California Department of Fish <br />and Wildlife or U.S. Fish and Wildlife Service? <br />No Impact. The replacement park sites were previously developed as residential use, are not located within an <br />area known as having riparian habitat or other sensitive natural community. Implementation of the proposed <br />project would not have an adverse effect on any riparian habitat or other sensitive natural community. No <br />impact would occur, and no mitigation measures are required. <br />c) Have a substantial adverse effect on state or federally protected wetlands (including, but not <br />limited to, marsh, vernal pool, coastal, etc.) through direct removal, filling, hydrological <br />interruption, or other means? <br />No Impact. The replacement park sites are in urbanized area surrounded by urban uses, acid do not contain <br />any wetland as defined by Section 404 of the Clean Water Act (CWA) (including, but not limited to marsh, <br />veinal pool, coastal, etc) and no such wetlands exist in the vicinity (USFWS 2017). No impacts to wetland <br />would occur, and no impact would occur. No mitigation measures are necessary. <br />d) Interfere substantially with the movement of any native resident or migratory fish or wildlife <br />species or with established native resident or migratory wildlife corridors, or impede the use of <br />native wildlife nursery sites? <br />Less Than Significant Impact. The replacement park sites are vacant but surrounded by urban development <br />There are no adjacent contiguous open space areas that could function as migratory wildlife corridors or native <br />wildlife nurseries. However, there are existing mature trees that could be used for nesting by migratory birds <br />protected under the federal Migratory Bud Treaty Act (MBTA) (United States Code, Title 16, Sections 703- <br />712). When removing trees of vegetation, in compliance with California Fish and Game Code Sections 3503, <br />3503.5, 3513, and 3800, the proposed project is required to avoid the incidental loss of fertile eggs or nestlings <br />or other activities that otherwise lead to nest abandonment Therefore, the city is required to conduct pre - <br />construction survey prior to removal of nesting habitat if construction related vegetation removal occurs <br />during nesting season (typically between February 1 and September 1). Compliance with the existing regulation <br />would ensure that the proposed project does not interfere substantially with the movement of any native <br />resident or wildlife species of with established native resident or migratory wildlife corridors. Impacts would <br />not be significant, and no mitigation measures are required. <br />75C-84 <br />
