Any decision of GIOC, the State or the Federal government relating to the complaint shall be binding on SAOS. 1.22 EDD Independent Contractor Reporting Requirements. Effective January 1, 2001, GIOC is required to file federal Form 1099-Misc for services received from a "service provider" to whom GIOC pays $600 or more or with whom GIOC enters into a contract for $600 or more within a single calendar year attached hereto as Exhibit 6 and incorporated herein by this reference. The purpose of this reporting requirement is to increase child support collection by helping to locate parents who are delinquent in their child support obligations. The term "service provider" is defined in California Unemployment Insurance Code Section 1088.8, subparagraph B.2 as "an individual who is not an employee of the service recipient for California purposes and who received compensation or executes a contract for services performed for that service recipient within or without the state." The term is further defined by the California Employment Development Department to refer specifically to independent contractors. An "independent contractor" is defined as "an individual who is not an employee of the ... government entity for California purposes and who receives compensation or executes a contract for services performed for that ... government entity either in or outside of California." The reporting requirement does not apply to corporations, general partnerships, limited liability partnerships, and limited liability companies. SAOS certifies that this CONTRACT does not aid or advance any religious sect, church or creed for a purpose that is sectarian in nature, nor does it help to support or sustain any school, college, university, hospital or other institution controlled by any religious creed, church, or sectarian denomination. 1.24 Fraud. (a) SAOS shall immediately report all suspected or known instances and facts concerning possible fraud, abuse or criminal activity under this CONTRACT. SAOS shall inform staff and the general public of how to report fraud, waste or abuse through appropriate postings of incident reporting notice. (b) SAOS confirms that none of its officers have been convicted of fraud or misappropriation of funds within the last two (2) years. 1.25 Standards of Conduct. (a) General Assurance. Every reasonable course of action will be taken by SAOS in order to maintain the integrity of this expenditure of public funds and to avoid favoritism and questionable or improper conduct. This CONTRACT will be administered in an impartial manner, free from efforts to attain personal, financial or political gain.
