Any decision of GIOC, the State <br />or the Federal government relating to the complaint shall be binding on SAOS. <br />1.22 EDD Independent Contractor Reporting Requirements. Effective January 1, <br />2001, GIOC is required to file federal Form 1099-Misc for services received from a "service <br />provider" to whom GIOC pays $600 or more or with whom GIOC enters into a contract for $600 <br />or more within a single calendar year attached hereto as Exhibit 6 and incorporated herein by this <br />reference. The purpose of this reporting requirement is to increase child support collection by <br />helping to locate parents who are delinquent in their child support obligations. <br />The term "service provider" is defined in California Unemployment Insurance Code <br />Section 1088.8, subparagraph B.2 as "an individual who is not an employee of the service recipient <br />for California purposes and who received compensation or executes a contract for services <br />performed for that service recipient within or without the state." The term is further defined by <br />the California Employment Development Department to refer specifically to independent <br />contractors. An "independent contractor" is defined as "an individual who is not an employee of <br />the ... government entity for California purposes and who receives compensation or executes a <br />contract for services performed for that ... government entity either in or outside of California." <br />The reporting requirement does not apply to corporations, general partnerships, limited <br />liability partnerships, and limited liability companies. <br />Additional information on this reporting requirement can be found at the California <br />Employment Development Department web site located at <br />http://www.edd.ca.gov/Payroll_Taxes/Independent_ Contractor Reporting.htm. <br />1.23 Sectarian Activities. SAOS certifies that this CONTRACT does not aid or <br />advance any religious sect, church or creed for a purpose that is sectarian in nature, nor does it <br />help to support or sustain any school, college, university, hospital or other institution controlled <br />by any religious creed, church, or sectarian denomination. <br />1.24 Fraud. <br />(a) SAOS shall immediately report all suspected or known instances and facts <br />concerning possible fraud, abuse or criminal activity under this CONTRACT. SAOS shall <br />inform staff and the general public of how to report fraud, waste or abuse through <br />appropriate postings of incident reporting notice. <br />(b) SAOS confirms that none of its officers have been convicted of fraud or <br />misappropriation of funds within the last two (2) years. <br />1.25 Standards of Conduct. <br />(a) General Assurance. Every reasonable course of action will be taken by <br />SAOS in order to maintain the integrity of this expenditure of public funds and to avoid <br />favoritism and questionable or improper conduct.
