*:1:111111i1 <br />LS 11.19.19 <br />RESOLUTION NO. 2019-xx <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AFFIRMING THE RECOMMENDATION OF THE <br />PLANNING COMMISSION DENYING THE CERTIFICATION OF <br />FINAL ENVIRONMENTAL IMPACT REPORT NO. 2018-01 (SCH <br />#2018021031), AND DENYING AMENDMENT APPLICATION NO. <br />2018-10, DEVELOPMENT AGREEMENT NO. 2018-01, AND <br />GENERAL PLAN AMENDMENT NO. 2018-06 FOR THE <br />PROPOSED MULTI -FAMILY RESIDENTIAL PROJECT LOCATED <br />WITHIN THE CITY OF SANTA ANA AT 2525 NORTH MAIN <br />STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />WHEREAS, Jeremy Ogulnick, representing AC 2525 Main LLC <br />("Applicant'), is requesting that the City Council certify Final Environmental Impact <br />Report (EIR) No. 2018-01 and adopt the findings of fact, statement of overriding <br />considerations, and the Mitigation Monitoring and Reporting Program for the <br />proposed project. Further, the applicant is requesting approval of Development <br />Agreement No. 2018-01, General Plan Amendment No. 2018-06, and <br />Amendment Application No. 2018-10 to allow the construction of a 256-unit multi- <br />family apartment project and surface level parking at the property located at 2525 <br />North Main Street; and <br />WHEREAS, the site contains a two-story, 81,000 square foot office building <br />that has been vacant for several years. The Applicant proposes to redevelop the <br />site with a residential use; and <br />WHEREAS, on October 28, 2019, the Planning Commission conducted a <br />duly noticed public hearing to consider the EIR, Development Agreement No. <br />2018-01, General Plan Amendment No. 2018-06, and Amendment Application <br />No. 2018-10 and solicited comments on the EIR. At the meeting, sixty-two (62) <br />speakers expressed opposition and two (2) expressed support of the project. In <br />addition, ninety-eight (98) individuals submitted comments with ninety-four (94) in <br />opposition and four (4) in support; and <br />WHEREAS, after hearing all relevant testimony from staff, the Applicant, <br />the public and the City's consultant team, the Planning Commission by a vote of <br />3:2, voted to recommend denial of the project. Since the entitlements require final <br />action by the City Council, the actions were forwarded to the City Council; and <br />WHEREAS, on November 8, 2019, the City gave public notice of a City <br />Council public hearing for consideration of Environmental Impact Report No. <br />Resolution No. 2019-xx <br />EXHIBIT 1 Page 1 of <br />
