Main Street, Santa Ana, California ("Property"). The Project site is located <br />across from the Discovery Cube of Orange County, on the opposite side of Main Street. The <br />Project site also abuts the Park Santiago residential neighborhood, which is adjacent to Santiago <br />Park and Santiago Creek, designated open space area. <br />12. On information and belief, the Project includes a proposal to sell 1.4 acres of the <br />Property to Discovery Science Center. Applicant and Discovery Science Center seek to enter into <br />a mutual parking agreement to share a parking lot on a 1.4 acre portion of the parcel that is <br />revocable at any time and by either party. This parking agreement is contingent upon the City <br />first issuing a certificate of occupancy. This contingency is problematic in part because a <br />ministerial certificate may only be issued well -after the requisite discretionary approval. <br />13. Upon information and belief, in or about late 2017, the City began preparing a <br />Draft Environmental Impact Report ("Draft EIR"). As initially proposed by the Applicant, as <br />distinct from the ultimate Project, the plans included a multi -family residential development of <br />496 units (the "Initial Plan"). Petitioner's members staunchly opposed, and one or more of them <br />publicly commented on, the Initial Plan and its Draft EIR. The City failed to meaningfully <br />respond. <br />14. In the Draft EIR, the Initial Plan included the following project description: <br />3.3 Project Site Description <br />The project site consists of 5.93 acres of land that is developed with one <br />vacant two-story office building. The office building is 81,172 square feet <br />in size, was constructed in 1982 and used by the Wells Fargo bank until <br />July 2017. The office building is located on the northwestern portion of the <br />project site. The building is divided into east and west wings connected by <br />a central two-story lobby area. The remainder of the project site consists <br />of paved driveways, surface parking areas that include 442 parking spaces, <br />and landscaping. A portion of the existing spaces (no more than 175 per <br />the existing use agreement) are currently used by the Discovery Cube for <br />overflow and employee parking. <br />3.6 Project Characteristics <br />The proposed project would redevelop the 5.9-acre project site to provide <br />496 for -rent multi -family residential units. The residences would be <br />provided within approximately 572,075 square feet of residential <br />4516.101 / 8560319.1 <br />VERIFIED PETMON FOR WRIT OF MANDATE/MANDAMUS <br />
