That the proposed use will provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community. <br />The proposed after-hours operations will allow the facility to <br />be rented during the evening hours on the weekend for <br />meetings, parties, ceremonious gatherings, dining, and/or <br />entertainment. Specifically, the subject The Place Banquet <br />Hall is proposing to remain open until 1:00 a.m. on Friday, <br />Saturday and Sunday. The after-hours operation will only <br />occur on the weekends when the nearby businesses are not <br />in use. <br />2. That the proposed use will not, under the circumstances of the <br />particular case, be detrimental to the health, safety, or general <br />welfare of persons residing or working in the vicinity. <br />The proposed after-hours operation will not be detrimental to <br />those living or working in the area because conditions have <br />been placed on the conditional use permit to mitigate any <br />negative impacts on the community. These conditions are <br />consistent with other eating establishments and banquet <br />facilities that have similar hours of operation and similar <br />operational conditions. Allowing the banquet facility to <br />provide this service will not create any new impacts on the <br />adjacent land uses. The Place Banquet Hall is located within <br />the General Commercial (C2) zone. Additionally, the <br />surrounding uses to the south and west will not be in use <br />during the banquet facility hours, with the exception of the <br />religious institution to the east, which is operational in the <br />evening hours. Additionally, the CUP includes a condition <br />that requires an entertainment permit for any live <br />entertainment. The operational standards for the live <br />entertainment include requirements that music/noise shall <br />not be audible beyond 20 feet from the exterior of the <br />premises in any direction, a security plan reviewed by the <br />Police Department, contracted security guards (one security <br />guard per 100 attendees), a closed circuit television system, <br />maintenance of an incident log, no loitering policy, and <br />alternative transportation plan. <br />3. That the proposed use will not adversely affect the present economic <br />stability or future economic development of properties surrounding <br />the area. <br />1- 32
