REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 3, 2020 <br />TITLE <br />ADOPT A RESOLUTION APPROVING A <br />ONE-YEAR EXTENSION OF THE <br />VARIANCE NO. 2017-09 AND TENTATIVE <br />TRACT MAP NO. 2017-03 FOR THE TOM'S <br />TRUCKS DEVELOPMENT TO BE LOCATED <br />AT 1008 EAST FOURTH STREET <br />/s/Kristine Ridge <br />CITY MANAGER <br />CLERK OF COUNCIL USE ONLY: <br />_••e• <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1 s' Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For_ <br />rK•�rnutn�.ic. <br />FILE NUMBER <br />RECOMMENDED ACTION <br />Adopt a resolution approving a one-year extension of Variance No. 2017-09 and Tentative Tract <br />Map No. 2017-03 to February 20, 2021. <br />DISCUSSION <br />On February 20, 2018, the City Council affirmed the Planning Commission's decision to approve a <br />variance and tentative tract map for the Tom's Truck residential development, which will consist of <br />33 townhome units and 84 single-family units at 1008 East Fourth Street. Specifically, the variance <br />was to allow a reduction in parking and in the maximum allowable building ratios for a single-family <br />development within the Transit Zoning Code boundaries, while the tentative map was to allow the <br />subdivision of the site into an 84-unit small lot subdivision. Due to lengthy and unexpected soil <br />remediation efforts needed on the premises, the applicant has been unable to move forward with the <br />permitting for the residential development. <br />Pursuant to City of Santa Ana Municipal Code Section 41-647, where construction does not <br />commence, these types of entitlements expire after two (2) years unless the applicant applies for, <br />and the City Council approves, an extension. The applicant submitted an extension request to the <br />Planning Division on January 29, 2020, prior to the expiration of the entitlements. <br />Upon completion of the remediation efforts, the applicant will be working with a housing developer <br />and the necessary team of experts, including an architect and project manager, to prepare <br />construction plans for submittal into Building plan check. The applicant expects to submit into <br />Building plan check by the end of the year and start construction early next year. Since the applicant <br />is planning to move forward with the project, the Planning Division recommends that the entitlements <br />for the development be extended by a period of one year to February 20, 2021. <br />55B-1 <br />
