LS 3.3.20 <br />RESOLUTION NO. 2020-xx <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA FOR A ONE YEAR EXTENSION OF <br />VARIANCE NO. 2017-09 AND TENTATIVE TRACT MAP <br />NO. 2017-03 FOR THE TOM'S TRUCKS RESIDENTIAL <br />DEVELOPMENT TO BE LOCATED AT 1008 EAST <br />FOURTH STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. In February 2018, the City Council affirmed the Planning Commission's <br />recommendation to approve Variance No. 2017-09 and Tentative Tract Map <br />No. 2017-03 to allow the development of the 133-unit Tom's Trucks <br />residential project at 1008 East Fourth Street. <br />B. Due to the need to complete unanticipated soil remediation on the <br />premises, the applicant has been unable to move forward with the <br />development and is requesting an extension for the variance and tentative <br />map. It is the Planning Division's policy to recommend no more than one <br />year extensions, mainly in an effort to encourage the construction of <br />previously approved projects. <br />C. Upon completion of the remediation efforts, the applicant will be working <br />with a housing developer and the necessary team of experts, including an <br />architect and project manager, to prepare construction plans for submittal <br />into Building plan check. The applicant expects to submit into Building <br />plan check by the end of the year and start construction early next year. <br />D. Pursuant to City of Santa Ana Municipal Code Section 41-647, where <br />construction does not commence, these types of entitlements expire after <br />two (2) years unless the applicant applies for, and the City Council <br />approves, an extension. <br />E. The extension request came before the City Council on March 3, 2020. <br />F. In accordance with the California Environmental Quality Act (CEQA) and <br />the CEQA Guidelines, the extension for this project is exempt pursuant to <br />Section 15061(b)(3). This determination has been made as it has been <br />determined that the proposed action does not have the potential to cause a <br />significant effect on the environment. <br />55B-3 Resolution No. 2020-xx <br />Page 1 of 3 <br />
