processing material to achieve the required levels of Diversion, emerging methods of <br />processing and Recycling/reusing new waste materials, the availability of markets, and <br />the impact of scavenging. City shall consider such information provided by Contractor <br />and other industry data and shall, at its sole discretion, determine if any adjustments to <br />the minimum Diversion requirements shall be made, and such changes must be <br />approved by the City Council before becoming effective. <br />If these Diversion requirements are not met, City may instruct Contractor to initiate <br />new programs at Contractor's expense in order for this goal to be met on a consistent <br />basis. <br />4.6.2 Organic Materials Processing <br />Contractor shall process recovered Organic Materials in a manner that maximizes <br />diversion credit for City in accordance with CalRecycle regulations. <br />4.6.3 End Uses for Organic Materials <br />Contractor shall Divert from landfilling Organic Material Collected through weekly <br />Cart, bundle, Bin and Roll -off Box Collection, holiday tree Collection, and Mixed Waste <br />Processing from Disposal. Contractor must provide end uses for Organic Material that <br />maximizes Diversion credits for City according to regulations established by AB 1594. <br />Contractor is responsible for monitoring how the Organic Material will be diverted at <br />selected facilities and for selecting alternative facilities if necessary to ensure full <br />Diversion credit. Failure to do so places the Contractor in default. City has the option, <br />but not obligation, to direct Contractor where to deliver the material, and if City directs <br />Contractor to an alternative Facility then Contractor may request a rate adjustment in <br />accordance with Section 2.10.2. <br />4.6.4 Bulky Item Diversion <br />Bulky Items Collected by Contractor in accordance with Sections 4.2.10 and 4.3.14, or <br />otherwise Collected under this Agreement, may not be landfilled or disposed of until <br />the following hierarchy of Diversion efforts has been followed by Contractor: <br />1) Reuse as is <br />2) <br />3) <br />Disassemble for reuse or Recycling <br />Recycle or market and sell Recyclable Materials for Recycling <br />March 9, 2020 57 City of Santa Ana - DRAFT <br />60A-146 <br />
