Recyclable Materials without sale, subject to on -going review by the City. In the event <br />market conditions for said Recyclable Materials change such that they can, once again, <br />be sold by Contractor, City may withdraw its consent for Contractor to dispose of said <br />Recyclable Materials and may, again, require Contractor to sell said Recyclable <br />materials as otherwise provided in this Agreement. <br />4.7 Operations <br />4.7.1 Schedules <br />To preserve peace and quiet, Solid Waste shall only be Collected from Residential areas <br />between 6:00 A.M. and 6:00 P.M. Monday through Friday. Solid Waste may be <br />Collected from Commercial and industrial locations between 3:00 A.M. and 9:00 P.M. <br />Monday through Saturday, provided that said Commercial and industrial locations are <br />at least one hundred (100) feet away from Residential units. Commercial and <br />industrial locations which are less than one hundred (100) feet away from Residential <br />units shall be treated as Residential areas and Solid Waste may only be collected from <br />those locations between 6:00 A.M. and 6:00 P.M. Monday through Friday. Further, if <br />complaints are received from Residential units which are at least one hundred (100) feet <br />away from Commercial and industrial locations, the Executive Director may direct that <br />collections in such Commercial or industrial areas shall be made between the hours of <br />6:00 A.M. and 6:00 P.M., and in that event Contractor agrees to comply with such order. <br />Contractor may not make exceptions to these Collection days and times without <br />advanced written approval from the City. If the regularly scheduled Collection day falls <br />on New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, <br />or Christmas Day, Collection days for the remainder of that week shall all be postponed <br />one Collection day and Residential Collection is permitted on Saturday during the <br />make-up week. <br />Contractor shall annually review with the City its operations plan outlining the <br />Collection routes, intervals of Collection and Collection times for all materials Collected <br />under this Agreement upon 30-day written notice requesting said review. More <br />frequent reviews may be required by City if operations are not satisfactory based on <br />documented observations, reports or complaints. If the plan is determined to be <br />inadequate by City, Contractor shall revise the plan incorporating any changes into a <br />revised plan and review said revised plan with City within thirty (30) calendar days. <br />March 9, 2020 59 City of Santa Ana - DRAFT <br />60A-148 <br />
