1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />21.2 Client Records: <br />21.2.1 CONTRACTOR shall prepare and maintain accurate and <br />complete records of clients served, and dates and type of services provided <br />under the terms of this Agreement in a form acceptable to ADMINISTRATOR. <br />21.2.2 All client records related to services provided under the <br />terms of this Agreement shall be retained by CONTRACTOR for a minimum of five <br />(5) years from the date of final payment under this Agreement or until all <br />pending COUNTY, State and Federal audits are completed, whichever is later. <br />Notwithstanding anything to the contrary, upon termination of this Agreement, <br />CONTRACTOR shall relinquish control with respect to client records to COUNTY. <br />in accordance with Subparagraph 37.2. <br />21.2.3 COUNTY may refuse payment for a claim if client records <br />are determined by COUNTY to be incomplete or inaccurate. In the event client, <br />records are determined to be incomplete or inaccurate after payment has been <br />made, COUNTY may treat such payment as an overpayment within the provisions of <br />this Agreement. <br />21.3 Public Records: <br />With the exception of client records or other records referenced <br />in Paragraph 26, entitled Confidentiality, all records, including but not <br />limited to, reports, audits,. noti,ces, claims, statements and correspondence, <br />required by this agreement may be subject to public disclosure. COUNTY will <br />not be liable for any such disclosure. <br />21.4 Inspections and Audits: <br />21..4.1 The Department of Health and Human Services, Comptroller <br />General of the United States, Director of the California Department of Social <br />Services, State Auditor -General, ADMINISTRATOR, COUNTY's Auditor -Controller <br />and Internal Audit Department, or any of their authorized representatives, <br />shall have access to any books, documents, papers and records, including <br />(W0209) 28 of 40 (3/18/09) <br />
