Any overpayments made by COUNTY which result from a <br />payment by any other funding source shall be repaid, at the discretion of ADMINISTRATOR, to <br />COUNTY or the funding source. Unless earlier repaid, CONTRACTOR shall make repayment <br />within thirty (30) days after the date of the final audit findings report and prior to any <br />administrative appeal process. In the event an overpayment owing by CONTRACTOR is collected <br />from COUNTY by the funding source, then CONTRACTOR shall reimburse COUNTY within <br />thirty (30) days thereafter and prior to any administrative appeal process. CONTRACTOR agrees <br />to pay all costs incurred by COUNTY necessary to enforce the provisions set forth in this <br />Paragraph. <br />22. OUTSTANDING DEBT <br />CONTRACTOR shall have no outstanding debt with COUNTY, or shall be in the process <br />of resolving outstanding debt to ADMINISTRATOR's satisfaction, prior to entering into and <br />during the term of this Agreement. <br />23. REVENUE <br />23.1 Whenever CONTRACTOR receives any money specifically designated for use in <br />programs funded through this Agreement, such monies shall be considered a cost off -set and <br />treated as a reduction against the amount claimed by CONTRACTOR, except for Program Income <br />as defined in Title 45 CFR Section 92.25, as that section currently exists or may be hereafter <br />amended. The procedure for designating money as Program Income is set forth in Paragraph 24 <br />of this Agreement. <br />24. PROGRAM INCOME <br />It is mutually understood that the State or federal agency responsible for providing the <br />funding for this Agreement may designate certain revenue of CONTRACTOR as Program Income. <br />To be designated as Program Income and, therefore, as other than a cost off -set, CONTRACTOR <br />shall do all of the following: <br />24.1 Submit a plan to ADMINISTRATOR for the use of any and all proposed Program <br />WGM0319 <br />Pa e 23 of 40 <br />25�-25 <br />3-31-2020 <br />
