• owns or rents personal property, which must be moved in connection with such <br />displacement and for which an expense would be incurred in such move; <br />• is not operated at the displacement site solely for the purpose of renting the dwelling <br />or site to others; <br />• cannot be a part of a commercial enterprise having at least three other <br />establishments which are not being acquired by the Developer, and which is under <br />the same ownership and engaged in the same or similar business activities; <br />• must not be able to relocate without substantial loss of patronage; and <br />• contributed materially, as defined by the Developer, to the income of the displaced <br />person during the two taxable years prior to displacement. <br />Payment of Relocation Benefits <br />Relocation benefit payments will be made expeditiously. Claims and supporting documentation <br />for relocation benefits must be filed with the displacing entity within eighteen (18) months from: <br />(i) the date the claimant moves from the acquired property; - or — (ii) the date on which final <br />payment for the acquisition of real property is made, whichever is later. Procedures for preparing <br />and filing claims and processing and delivering of payments will be as follows: <br />1. Claimant to provide all necessary documentation to substantiate eligibility for <br />assistance. <br />2. Assistance amounts will be determined in consultation with the Developer and <br />required claim forms prepared by relocation staff in consultation with claimant. <br />3. Original signed claims supported by documentation and relocation staff <br />recommendation will be submitted to the designated the Developer staff member <br />or his/her designee. <br />4. Payments will be prepared and delivered to relocation staff for distribution. <br />Payments will be delivered personally by relocation staff, unless circumstances <br />dictate otherwise. When payments cannot be personally delivered, they will be sent <br />by certified mail. <br />5. Payment receipts and other signed acknowledgments will be obtained by relocation <br />staff and kept in the case file. <br />6. Unless otherwise instructed by the Developer, relocation staff will not deliver final <br />payments until the project site premises occupied by the claimant has been <br />completely vacated. <br />7.
