Any paid time off during the workweek for vacation leave, sick leave, holiday leave, <br />compensatory time off, Chapter Chair/President's Leave, Union Business Leave, and all <br />unpaid leave (including furlough days) shall not be counted towards the hours worked in a <br />workweek for the computation of payment for overtime. unless the hours in excess of forty <br />(40) hours in a workweek (including the above listed time) are worked by the employee at <br />the requirement of his/her supervisor or by management. <br />6.4 Compensation for Overtime <br />The City's preferred method by which overtime shall be compensated is by monetary <br />payment, at one and one-half (1.5) times the employee's regular rate of pay, subject to the <br />provisions of Section 6.5. <br />6.5 Compensatory Time <br />A. Overtime Conversion to Compensatory Time <br />Should the Department Head determine that the best interests of the City will be <br />served thereby, his/her designee may permit an employee to be compensated for <br />overtime work by earning compensatory time off at the rate of one and one-half <br />(1.5) hours for each overtime hour worked. <br />B. Maximum Accumulation of Compensatory Time <br />Employees shall have the option to earn up to a maximum of eighty (80) hours of <br />compensatory time off. <br />C. Use of Compensatory Time <br />1. Since compensatory time is earned atone and one-half (1.5) hours for each hour <br />of overtime worked, eighty (80) hours of compensatory time equates to fifty- <br />three point thirty-three (53.33) hours of overtime worked. <br />2. Such compensatory time off shall be taken at the discretion of the employee, <br />when requested at least seventy-two (72) hours in advance, subject to the <br />operational needs and staffing requirements of the department. <br />3. If the Department Head or his/her designee subsequently denies the requested <br />compensatory time off, the employee and department will mutually agree on a <br />future date within one (1) year when the employee can use the paid <br />compensatory time off. <br />If the requested compensatory time off is not used within that one (1) year, such <br />compensatory time may be paid off in cash. <br />2019-2022 MOU City of Santa Ana & SEIU Part -Time Civil Service Employees Unnage 26 <br />20C-29 <br />
