B. Sick Leave during Vacation <br />Should an employee suffer a sickness or injury while on authorized vacation, each <br />full day of such sick leave, when confirmed by a physician's statement and approval <br />of the Department Head, may be deducted from the computation of vacation <br />expended and charged against the employee's accumulated sick leave as available. <br />8.5 Vacation Cash -Out <br />A. Annual Buy Back <br />1. Through December 31, 2020 <br />Employees shall have the option to receive cash for banked vacation leave, as <br />follows: <br />Y July 1, 2019 through June 30, 2020: Up to thirty-six (36) hours. <br />July 1, 2020 through December 31, 2020: Up to eighteen (18) hours. <br />2. Effective January 1 2021 and continuing every year thereafter <br />a. If an employee wants to cash -out unused vacation leave they accrued during <br />the calendar year, they must make an irrevocable election by December 15'h <br />of the prior calendar year (i.e. by December 15, 2020 for a cash -out in <br />calendar year 2021). <br />b. The irrevocable election must indicate the amount of vacation hours the <br />employee intends to cash -out during that next calendar year. <br />The number of hours to be cashed -out can not exceed the total number of <br />hours the employee will accrue during that same calendar year, or a <br />maximum of one hundred (100) hours, wh chever is the lesser amount. <br />c. Once the election form is submitted to Human Resources, the amount of <br />hours to be cashed -out can not be changed for that calendar year. <br />d. Employees may submit a request for cash -out up to two times (2X) per year <br />— for payment in the pay period which includes July 1 and/or December 15. <br />e. In the event an employee's vacation leave balance (on either pay period <br />when he/she can elect to cash -out) is less than the amount of hours the <br />employee had previously elected to cash -out (in the prior calendar year), the <br />employee will only receive payment for the amount of accumulated <br />vacation leave remaining at the time of the cash -out in either July or <br />2019-2022 MOU City of Santa Ana & SEW Part -Time Civil Service Employees Uni ge 36 ff ^ <br />20C-39 <br />
