L S A FAIRVIEW BRIDGE REPLACEMENT AND STREET IMPROVEMENTS <br />(9TH STREET TO 16TH STREET( PROJECT INITIAL STUDY/MITIGATED NEGATIVE DECLARATION <br />SANTA ANAL CALIFORNIA MAY 2020 <br />species. Mitigation Measure BIO-8 includes BMPs to prevent loose soil or pollutants associated with <br />the proposed Project from inadvertently entering the channel to protect water quality. Mitigation <br />Measure BIO-9 includes BMPs to prevent the spread of invasive plant species that could degrade <br />aquatic habitat areas. <br />Therefore, with implementation of Mitigation Measures BIO-7 through BIO-9, the proposed Project <br />would not have a substantial adverse effect on State or federally protected wetlands (including, but <br />not limited to, marsh, vernal pool, coastal, etc.) through direct removal, filling, hydrological <br />interruption, or other means. Impacts would be less than significant with mitigation incorporated. <br />d. Would the project interfere substantially with the movement of any native resident or migratory <br />fish or wildlife species or with established native resident or migratory wildlife corridors, or <br />impede the use of native wildlife nursery sites? <br />Less Than Significant Impact. An official Endangered Species Act Species List was obtained from the <br />National Oceanic and Atmospheric Administration Fisheries Service (NOAA Fisheries) on March 16, <br />2018. An updated official species list was received on October 28, 2018, and is included in <br />Appendix A of the NES. No Essential Fish Habitat is present in the BSA, and a No Effect determination <br />was made for the Federal Endangered Species Act (FESA) listed species identified during the <br />literature review; therefore, no further consultation with NOAA Fisheries is anticipated to be <br />required. <br />As identified above, the BSA encompasses the Project direct -impact areas (temporary and <br />permanent) as well as a buffer area to account for any potential proximity effects (e.g., noise, <br />vibration, dust, or lighting) that may occur outside the direct -impact areas. The BSA is located within <br />urban portions of Santa Ana with no connection to undisturbed or natural lands. The proposed <br />Project would have limited permanent impacts to vegetation in the BSA, which mainly consists of <br />ornamental or ruderal (weedy) species that have low habitat value for most native animal species. <br />The wildlife species that occur in the Project vicinity are adapted to the urban—wildland interface, <br />and the Project would not introduce new affects to the area. The noise, vibration, light, dust, or <br />human disturbance within construction areas would only temporarily deter wildlife from using areas <br />in the immediate vicinity of construction activities. These indirect effects could temporarily alter <br />migration behaviors, territories, or foraging habitats in select areas. However, because these are <br />temporary effects, it is likely that wildlife already living and moving in close proximity to urban <br />development would alter their normal functions for the duration of the Project construction and <br />then reestablish these functions once all temporary construction effects have been removed. The <br />proposed Project would not place any permanent barriers within any known wildlife movement <br />corridors or interfere with habitat connectivity. Therefore, the proposed Project would not have a <br />substantial impact on native resident or migratory fish, migratory wildlife corridors, or native wildlife <br />nursery sites. Impacts would be less than significant, and no mitigation is required. <br />e. Would the project conflict with any local policies or ordinances protecting biological resources, <br />such as a tree preservation policy or ordinance? <br />No Impact. The Project area is located in an urban setting.
