In addition, the City's Municipal Code Chapter 33, <br />Article VII, Regulation of the Planting, Maintenance, and Removal of Trees establishes policies, <br />regulations, and standards to ensure that the City continues to realize the benefits provided by its <br />urban forest. The Project would require removal of vegetation and ornamental trees and <br />replacement of the existing bridge and would comply with the City's tree ordinance. No impact <br />would occur, and no mitigation is required. <br />f. Would the project conflict with the provisions of an adopted Habitat Conservation Plan, Natural <br />Community Conservation Plan, or other approved local, regional, or state habitat conservation <br />plan? <br />No Impact. The Project area is not within the boundaries of any an adopted Habitat Conservation <br />Plan (HCP), Natural Community Conservation Plan (NCCP), or other approved local, regional, or State <br />habitat conservation plan. Therefore, the proposed Project would not conflict with the provisions of <br />an adopted HCP, NCCP, or other approved conservation plan, and no impacts would occur. No <br />mitigation is required. <br />3.4.3 Mitigation Measures <br />Mitigation Measure BIO-1 Nesting Bird Surveys and Avoidance. If vegetation removal, <br />construction, or grading activities are planned to occur within the <br />nesting bird season (February 1 to September 30), the City of Santa <br />Ana (City) Public Works Director or designee shall ensure that a <br />qualified biologist conducts a preconstruction nesting bird survey no <br />more than three days prior to the start of such activities. The <br />nesting bird survey shall include the Project site and areas <br />immediately adjacent to the site that could potentially be affected <br />by Project -related activities such as noise, vibration, increased <br />human activity, and dust, etc. For any active nest(s) identified, the <br />qualified biologist shall establish an appropriate buffer zone around <br />the active nest(s). The appropriate buffer shall be determined by <br />the qualified biologist based on the species, location, and nature of <br />the proposed activities. Project activities shall be avoided within the <br />buffer zone until the nest is deemed no longer active by the <br />qualified biologist. <br />Mitigation Measure BIO-2 Bat Eviction/Exclusion. To avoid direct mortality of individual bats, <br />the City Public Works Director or designee shall ensure that humane <br />evictions (if bats are present) and exclusions of roosting bats shall <br />be performed under the supervision of a California Department of <br />Fish and Wildlife (CDFW) approved bat biologist prior to bridge <br />demolition activities. Eviction/exclusion activities shall be <br />performed in the fall (September or October) prior to bridge <br />demolition.
