INITIAL STD DY/M ITIGATED NEGATIVE DECLARATION <br />MAY 2020 <br />FAIRVIEW BRIDGE REPLACE MENT AND STREET IMPROVEMENTS L S A <br />(9TH STREET TO 16TH STREET) PROJECT <br />SANTA ANAL CALL EORNIA <br />3.5.3 Mitigation Measures <br />Mitigation Measure CULT-1 Cultural Resources Discovery. If archaeological cultural resources <br />are encountered during construction, the Construction Contractor <br />shall ensure that work within 50 meters (165 feet) of the area of the <br />discovery is stopped and will notify the City of Santa Ana (City) <br />Public Works Director or designee. A professional archaeologist (i.e., <br />an archaeologist registered with the Register of Professional <br />Archaeologists) will be contacted and will visit the site to assess the <br />nature and significance of the find. The archaeologist will then <br />develop proper mitigation measures for the discovery. Work could <br />continue on other parts of the Project while cultural resources <br />mitigation takes place. <br />Mitigation Measure CULT-2 Human Remains. The City Public Works Director or designee shall <br />verify that all construction plans specify the requirements of <br />California Code of Regulations (CCR) Section 15064.5(e), State <br />Health and Safety Code Section 7050.5, and Public Resources Code <br />(PRC) Section 5097.98. <br />In the event that human remains are encountered in the Project <br />area during construction activities, work within 50 feet of the <br />discovery shall be redirected and the County Coroner notified <br />immediately consistent with the requirements of CCR Section <br />15064.5(e). If the remains are determined to be Native American, <br />the County Coroner shall notify the Native American Heritage <br />Commission (NAHC), which shall determine and notify a Most Likely <br />Descendant (MLD). With the permission of the landowner or his/her <br />authorized representative, the MLD may inspect the site of the <br />discovery. The MLD shall complete the inspection and make <br />recommendations or preferences for treatment within 48 hours of <br />being granted access to the site. The MLD recommendations may <br />include scientific removal and nondestructive analysis of human <br />remains and items associated with Native American burials, <br />preservation of Native American human remains and associated <br />items in place, relinquishment of Native American human remains <br />and associated items to the descendants for treatment, or any other <br />culturally appropriate treatment. <br />Consistent with CCR Section 15064.5(d), if the remains are <br />determined to be Native American and an MLD is notified, the City <br />Public Works Director or designee shall consult with the MLD, as <br />identified by the NAHC, to develop an agreement for treatment and <br />disposition of the remains. <br />R:\WKE1702\ISMND\Fina1 ISMND\Fairview Street Bridge Final ISMND7,05SM67 3-33 <br />
