Natural Environment Study (Minimal Impacts) <br />capacity/waters of the U.S. would occur under the Project. During construction, <br />temporary fill would be placed within the Santa Ana River channel associated with a <br />potential bike detour route, materials staging and access, and/or dewatering. Such <br />temporary fills would not permanently reduce channel capacity or result in the loss of <br />aquatic resources. <br />Since work would be occurring within nonwetland jurisdictional aquatic resources <br />associated with the Santa Ana River, resource agency permits (USACE Section 404 <br />Nationwide Permit authorization, CDFW Section 1602 Streambed Alteration <br />Agreement, and RWQCB Section 401 Water Quality Certification) are anticipated to <br />be required for the Project. In addition, the Santa Ana River is a USACE facility <br />under Section 14 ("Section 408") of the Rivers and Harbors Act of 1899, so Section <br />408 permission will also be required for the Project. <br />5.5. Nesting Birds <br />The BSA contains mature ornamental trees and other areas, including the culverts <br />where inactive cliff swallow nests were found, which could provide nesting habitat <br />for native birds. To avoid potential impacts to nesting birds that are protected under <br />the California Fish and Game Code and the MBTA, it is recommended that any <br />necessary vegetation removal be performed outside the bird nesting season (February <br />1—September 30). If vegetation removal cannot be performed outside the bird nesting <br />season or if construction is scheduled to begin during the nesting season, Measure <br />BI0-2 (refer to Section 4.1.4.3.) will be implemented to avoid adverse impacts to <br />nesting birds. <br />5.6. Invasive Species <br />A majority of the plants observed (Appendix B) within the BSA are classified as <br />Invasive Species and listed on the California Invasive Plant Council (Cal-IPC) <br />Inventory Database. Measure BIO-1 (refer to Section 4.1.1.3) contains provisions that <br />will be implemented to prevent the spread of exotic plant species. With <br />implementation of Measure BIO-1, the Project is not expected to disperse exotic plant <br />species seeds or otherwise contribute to the invasion of exotic species into natural <br />habitats. <br />6.
