California Department of Housing and Community Development ("HCD") <br />and asked to amend the Resolution to: specify that Applicant would use <br />the PLHA funds for the operation of a homeless navigation center; only <br />refer to the total NOFA amount, rather than an annual amount; and, <br />clarification on the public comment period. <br />H. The current Resolution hereby addresses HCD's comments and <br />supersedes Applicant's prior Resolution No. 2020-047. <br />Section 2. If Applicant receives a grant of PLHA funds from the Department <br />pursuant to the above referenced PLHA NOFA, it represents and certifies that it will use <br />all such funds in a manner consistent and in compliance with all applicable State and <br />federal statutes, rules, regulations, and laws, including without limitation all rules and <br />laws regarding the PLHA Program, as well as any and all contracts Applicant may have <br />with the Department. Specifically, pursuant to Applicant's PLHA Five -Year Plan, <br />Applicant intends to use the PLHA funds for the operation of a homeless navigation <br />center, including supportive service programs, and Applicant's administrative costs, as <br />allowed per the PLHA Guidelines and Program requirements. <br />Section 3. It is hereby confirmed that the public had adequate opportunity to <br />review and comment on the Plan during the public comment period, which ran from May <br />18, 2020, through June 4, 2020, and therefore the Plan is hereby authorized and <br />adopted by the City Council. Public comments on the Plan were received at the City <br />Council meeting on June 2, 2020, and are reflected in the meeting minutes, which were <br />forwarded to and accepted by HCD. <br />Section 4. Applicant is hereby authorized and directed to receive a PLHA <br />grant, in an amount not to exceed the five-year estimate of the PLHA formula <br />allocations, as stated in Appendix C of the current NOFA, which is $16,822,236, in <br />accordance with all applicable rules and laws. <br />Section 5. Applicant hereby agrees to use the PLHA funds for eligible <br />activities as approved by the Department and in accordance with all Program <br />requirements, Guidelines, other rules and laws, as well as in a manner consistent and in <br />compliance with the Standard Agreement and other contracts between the Applicant <br />and the Department. Specifically, pursuant to Applicant's PLHA Five -Year Plan, <br />Applicant intends to use the PLHA funds for the operation of a homeless navigation <br />center, including supportive service programs, and Applicant's administrative costs, as <br />allowed per the PLHA Guidelines and Program requirements. <br />Section 6. Applicant certifies that it has or will subgrant some or all of its PLHA <br />funds to another entity or entities. Pursuant to Guidelines Section 302(c)(3), "entity" <br />means a housing developer or program operator, but does not mean an administering <br />Local government to whom a Local government may delegate its PLHA allocation. <br />Resolution No. 2020-_ 55A-9 <br />
