Community Development Department <br />August 18, 2020 <br />Honorable Members of the Santa Ana City Council <br />c/o Ms. Daisy Gomez, Clerk of the Council <br />22 Civic Center Plaza <br />Santa Ana, CA 92701 <br />deomez(d)santa-ana.org <br />TUSTIN <br />BUILDING OUR FUTURE <br />HONORING OUR PAST <br />SUBJECT: FINAL ENVIRONMENTAL IMPACT REPORT AND RESPONSES TO COMMENTS FOR THE <br />BOWERY MIXED USE PROJECT (WARNER REDHILL MIXED -USE DEVELOPMENT) IN THE <br />CITY OF SANTA ANA <br />Dear Honorable Members of the City Council: <br />Thank you for this opportunity to express the City of Tustin's significant, ongoing concerns regarding the <br />potential impacts to the City of Tustin from The Bowery Mixed Use Project (recently renamed as the <br />"Warner Redhill Mixed -Use Development"), which is directly adjacent to the City of Tustin and the Tustin <br />Legacy master planned community. The City of Tustin provided comments on the project's Draft EIR and <br />to Santa Ana's Planning Commission. As explained in those comments, the City of Tustin is concerned by <br />Santa Ana's failure to comprehensively plan development in this corridor. And unfortunately, despite the <br />City of Tustin's best efforts to bring many issues to Santa Ana's attention, serious errors and unsupported <br />assumptions remain in the project's EIR. <br />The project is proposed at the southwesterly corner of Red Hill Avenue and Warner Avenue. The proposed <br />project consists of the development of a 14.58-acre site with 1,150 multiple family residences within five - <br />story to six -story buildings, wrapped parking structures, and 80,000 square feet of retail and restaurant <br />commercial space. The project also proposes approximately 174,555 square feet of open space within <br />courtyards, common areas, roof decks, perimeter plazas, and other open space areas. The project <br />requires General Plan Amendment from Professional and Administrative Office to a mixed -use <br />designation, and a Zone Change from Light Industrial to Specific Development. <br />In a letter dated February 5, 2020 (Attachment A), the City of Tustin provided comments to Santa Ana on <br />the Draft Environmental Impact Report (DEIR) for the project. On April 27, 2020, Santa Ana released the <br />Final FIR and Responses to Comments on the DEIR for the Project, which was received by the City of Tustin <br />Community Development Department on May 7, 2020. In response to the City of Tustin's request for a <br />continuance, and to the concerns raised by others, the Santa Ana Planning Commission continued the <br />hearing to May 26, 2020. The City of Tustin identified further concerns in a letter dated May 21, 2020 <br />(Attachment B). The City of Tustin reiterates each of these comments now. <br />The City of Tustin's staff has reviewed the Final EIR and the responses to the City of Tustin's comments <br />contained therein (Attachment Q.
