The first mistake we discussed in chambers <br />had to do with Page 8, the instructions after Question 40. <br />The instructions after Question 40 read: "If your answer to <br />Question 40 is yes, then answer Question 41." That should <br />have read: "If your answer to Question 40 is no, then answer <br />Question 41." <br />So I have made that correction upon the request of <br />counsel, and I believe it is correct. <br />Does anybody wish to be heard further as to that <br />correction? And I showed you what I had done. <br />MR. RUBINER: Nothing from us, your Honor. <br />MR. FELDMAN: No. <br />MR. COONTZ: Could I just take a minute to make <br />sure? I'm a little stunned right now. <br />No, I think that's correct, your Honor. <br />THE COURT: Okay. The next area was Section 9. <br />Quantum meruit on common count. The instruction reads: "If <br />you answered Question 9, even if your answer was zero, skip <br />this section and proceed to Section 13." <br />The agreement was it should have read Section 11, <br />and I've made that correction. <br />MR. RUBINER: Actually, your Honor, I think that's <br />also a mistake. It should be Section 10. They need to look <br />at Section 10 because Section 10 is quantum meruit as to <br />VDC at the Met. If they answered Question 21 -- if they <br />didn't answer Question 21, they are supposed to do Section 10, <br />and they skipped it.
