The City will have one City <br />Manager designated director position on the Travel Santa Ana Board of Directors. <br />Each year, Travel Santa Ana will present an annual report to City Council identifying the activities <br />of the Tourism Marketing District. The City Council will not be required to take further action on <br />the Tourism Marketing District after the final Public Hearing in November 2020, unless the City <br />receives written petitions from lodging businesses that pay 50% or more of the assessment to <br />disestablish the district. Lodging businesses will have this opportunity to petition each year (for a <br />period of 30 days) after the establishment of the SATMD. <br />SATMD ESTABLISHMENT SCHEDULE <br />September 15, 2020 RESOLUTION OF INTENTION HEARING <br />Upon the submission of a written petition, signed by the business owners in <br />the established district who will pay more than 50 percent of the <br />assessments proposed to be levied, the City Council may initiate <br />proceedings to establish a district by the adoption of a resolution expressing <br />its intention to establish a district. <br />Petition Status: Petitions in favor of SATMD establishment were submitted <br />by seven lodging businesses, which represent 58 percent of the total <br />SATMD assessment. This majority petition allows the Council to initiate <br />proceedings for SATMD establishment at the September 15, 2020 City <br />Council meeting. <br />September 16, 2020 NOTICE <br />The 94 Law requires the City to mail written notice to the owners of all <br />businesses proposed to be within the SATMD. Mailing the notice begins a <br />mandatory 45-day period in which owners may protest SATMD <br />establishment. <br />October 6, 2020 PUBLIC MEETING <br />Allow public testimony on the establishment of the SATMD and levy of <br />assessments. No City Council action is required. <br />November 17, 2020 FINAL PUBLIC HEARING <br />If written protests are received from the owners of businesses in the <br />established SATMD who will pay more than 50 percent of the assessments <br />proposed to be levied, and protests are not withdrawn so as to reduce the <br />protests to less than 50 percent, no further proceedings to levy the <br />proposed assessment against such businesses shall be taken for a period <br />of one year from the date of the finding of a majority protest by the City <br />Council. <br />At the conclusion of the public hearing to establish the SATMD, the City <br />Council may adopt, revise, change, reduce, or modify the proposed <br />12A-3 <br />
