Resolution No. 2020-xx Page 1 of 8 LS 3.23.20 RESOLUTION NO. 2020-xx BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Logan Crow, representing The Frida Cinema (“Applicant”), is requesting approval of Conditional Use Permit (“CUP”) No. 2020-11 to allow after- hours operations until 2:00 a.m. as well as after-hours sales, service, and consumption of beer, wine, and distilled spirits, at an existing non-profit theater located at 305 East Fourth Street, Unit 100. B. Santa Ana Municipal Code Section (“SAMC”) 41-196 requires approval of a CUP for the sale, service, and consumption of alcoholic beverages between the hours of 12:00 a.m. and 7:00 a.m. C. SAMC Section 41-2007 requires a CUP to allow any business to operate between the hours of 12:00 a.m. and 7:00 a.m. The Applicant is proposing to operate the business from 10:00 a.m. to 2:00 a.m., two hours later than the SAMC prescribed limits. D. Pursuant to SAMC Section 41-638, the Planning Commission is authorized to review and approve the CUP for this project as set forth by the Santa Ana Municipal Code. E. On March 23, 2020, the Planning Commission held a duly noticed public hearing for CUP No. 2020-11. F. The Planning Commission of the City of Santa Ana has considered the information and determines that following findings, which must be established in order to grant CUP No. 2020-11, to allow sales, service, and consumption of alcoholic beverages between the hours of 12:00 a.m. and 2:00 a.m., have been established as required by SAMC Section 41- 638: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2020-11 AS CONDITIONED TO ALLOW AFTER-HOURS OPERATIONS UNTIL 2:00 A.M. FOR THE FRIDA CINEMA LOCATED AT 305 EAST FOURTH STREET, UNIT 100 4 -17
