That the proposed use will provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community. <br />The proposed after-hours operations will provide a primary <br />service to individuals that may not be able to attend early <br />movie show times or that wish to experience late night movie <br />showings. This will allow the theater to better serve the <br />community by providing a movie theater service that provides <br />late night movie showings past 12:00 a.m. (midnight), which is <br />consistent with other business hours of operations in the <br />Downtown. In addition, by offering extended hours of <br />operation, the theater and Downtown area will be further <br />enhanced. <br />2. That the proposed use will not, under the circumstances of the <br />particular case, be detrimental to the health, safety, or general <br />welfare of persons residing or working in the vicinity. <br />The subject site contains an existing non-profit theater that <br />has been in operation since 2014. In addition, the existing <br />non-profit theater has sold alcoholic beverages for on- <br />premises consumption at special after-hours events by <br />obtaining a daily alcoholic permit through the California <br />Department of Alcoholic Beverage Control (“ABC”). Since <br />2014, the City has not received any complaints or issued any <br />notices of violation to the operator. Furthermore, the subject <br />site is not located within immediate proximity to parks, <br />playgrounds, schools, or religious institutions. In addition, the <br />building is located approximately 350 feet away from the <br />nearest multi-family residences and approximately 400 feet <br />from the nearest single-family residences. All applicable <br />operational standards identified in SAMC Sec. 41-196 will <br />apply to this establishment. Finally, the after-hours operation <br />is intended to be incidental to the primary use, which is a <br />theater. <br />3. That the proposed use will not adversely affect the present economic <br />stability or future economic development of properties surrounding <br />the area. <br />The Frida Cinema theater has been in operation for six years <br />at 305 East Fourth Street, Unit 100. Since 2014, The Frida <br />Cinema has shown on average 28 films per month and held <br />special private events. The proposed after-hours operations <br />will not adversely affect the economic stability of the area, but <br />will instead allow the theater to compete with other nearby <br />4 -18
