LS 10.12.20 <br />RESOLUTION NO. 2020-xx <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING VARIANCE NO. <br />2020-06 AS CONDITIONED TO ALLOW AN INCREASE IN <br />THE ALLOWABLE BUILDING SIZE AND MASSING ON <br />SITE B AS PART OF A NEW MIXED -USE RESIDENTIAL <br />AND COMMERCIAL DEVELOPMENT FOR THE <br />PROPERTIES LOCATED AT 409 EAST FOURTH STREET <br />(SITE A) AND 509 EAST FOURTH STREET (SITE B) <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Andrew Nelson, with Red Oak Investments, LLC, representing Northgate <br />Gonzalez Real Estate (hereinafter referred to as "Applicant"), is seeking <br />approval of various entitlements including Site Plan Review No. 2020-03, <br />Variance No. 2020-06, and Amendment Application No. 2020-04 to allow <br />the construction of a new mixed -use residential and commercial <br />development consisting of 169 residential rental units and 11,361 square <br />feet of commercial space at 409 and 509 East Fourth Street; and <br />B. The Applicant has requested approval of Variance No. 2020-06 as <br />conditioned, to exceed the allowable building size and massing standards <br />on Site B as part of the new mixed -use residential and commercial <br />development at 409 and 509 East Fourth Street; and <br />C. Santa Ana Municipal Code (SAMC) Section 41-2023(i)(5) of the Transit <br />Zoning Code requires that the maximum ratio of each lined block story, <br />between three and five stories, be 85 percent of the project's ground <br />floor's volume. <br />D. The Applicant is proposing an increase in the allowable maximum ratio for <br />the building on 509 East Fourth Street (Site B) for the third through fifth <br />floor, where each floor would be 100 percent of the building's ground floor <br />volume, exceeding the allowable ratio by 15 percent of the ground and <br />second floor volumes on each of floors three through five. <br />E. Pursuant to SAMC Section 41-638, the Planning Commission is <br />authorized to review and approve the variance for this project as set forth <br />by the Santa Ana Municipal Code. <br />I1=11 M61 crew-W018bT <br />75C-365 <br />
