Aqua Metric Bldg.16914 Alamo Parkway, Phone. 1 •. . 11 1 1 Change Order: CO-0001 Contract No.: A-2020-231 Change Date: October 4,2021 This Change Order is made by and between Thirkettle Corporation dba Aqua-Metric Sales Company ("Aqua- Metric")and the City of Santa Ana("Santa Ana")and in accordance with Section 4 of the Contractor Agreement (the"Agreement") executed between the parties on October 4,2020. Description of Change(s): I. Aqua-Metric and Santa Ana have identified various accounts within the City's water distribution system which may require a SmartPoint retrofit rather than a full meter replacement. A SmartPoint retrofit shall include affixing one SmartPoint radio transmitter, SmartPoint activation, and meter register reprogram. 2. The quantities outlined within Exhibit A herein have been approximated to calculate an adjusted project budget, however,the quantities may not be exact. In the event the proposed quantities differ from actual work invoiced, Aqua-Metric may adjust the actual quantities as necessary and in accordance with the work performed. 3. Where applicable,Aqua-Metric will invoice Santa Ana for a complete SmartPoint retrofit in lieu of a complete meter exchange and Santa Ana agrees to make full payment for the work completed and in accordance with the Payment Terms defined in the Agreement. The parties hereto agree to and accept the changes herein which will become effective upon signature from an authorized representative of each party hereto.This Change Order shall serve as an extension to the Agreement and any prior change order(s) in conjunction with the project and shall supersede any previous verbal or written representation of the current agreement.In the event of ambiguity,all predefined scope,terms,and conditions within the Agreement shall prevail unless otherwise stated herein.
