'• r ! <br /> Change Order: CO-0003 <br /> Contract No.: A-2020-231 <br /> Change Date: September 9,2022 <br /> This Change Order is made by and between Thirkettle Corporation dba Aqua-Metric Sales Company (`Aqua- <br /> Metric") and the City of Santa Ana ("Santa Ana")and in accordance with Section 4 of the Contractor Agreement <br /> (the"Agreement")executed between the parties on October 4,2020, <br /> Description of Change(s): <br /> 1. Due to economic and inflationary price increases, Aqua-Metric has identified various materials which have <br /> increased in material cost from Aqua-Metric's suppliers. The pricing attached hereto shall become effective <br /> immediately. <br /> 2. Where applicable, Aqua-Metric will invoice Santa Ana at the unit rates identified in the pricing hereto and <br /> Santa Ana agrees to make full payment for the materials delivered and in accordance with the Payment Terms <br /> defined in the Agreement. <br /> The parties hereto agree to and accept the changes herein which will become effective upon signature from an <br /> authorized representative of each party hereto.This Change Order shall serve as an extension to the Agreement and <br /> any prior change order(s) in conjunction with the project and shall supersede any previous verbal or written <br /> representation of the current agreement.
