REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />DECEMBER 15, 2020 <br />TITLE: <br />APPROVE AGREEMENTS WITH <br />MONUMENT ROW, OVERLAND PACIFIC & <br />CUTLER, THE ROW COMPANY, AND <br />CLARK LAND RESOURCES, INC., FOR <br />ON -CALL RIGHT-OF-WAY ACQUISITION <br />SERVICES IN AN AGGREGATE AMOUNT <br />NOT TO EXCEED $550,000 FOR UP TO A <br />FIVE-YEAR TERM <br />(NON -GENERAL FUND) <br />/s/ Kristine Ridge <br />CITY MANAGER <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1� Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute agreements with Monument ROW, Overland Pacific & <br />Cutler, LLC, The ROW Company, and Clarkland Resources, Inc., to provide on -call right-of-way <br />acquisition services for a total aggregate amount not to exceed $550,000 for the three-year term <br />beginning December 15, 2020, and expiring on December 14, 2023, with a provision for two, one- <br />year extensions exercisable by the City Manager and City Attorney, subject to non -substantive <br />changes approved by the City Manager and City Attorney. <br />DISCUSSION <br />On September 10, 2020, the Public Works Agency issued a Request for Proposal (RFP) for <br />consultants to provide on -call right-of-way acquisition services. The chosen consultants will <br />augment City staff with the following specialty services for the timely delivery of capital projects: <br />identify and manage right-of-way needs; right-of-way engineering; preparation and review of <br />property appraisals; preparation of temporary and/or construction easements; disposition and <br />excess of properties; relocation and relocation cost analysis; develop relocation plans and services <br />according to Relocation Law; and related documentation preparation and management for right-of- <br />way acquisition. <br />The RFP was advertised on the City's online bid management and publication system, with bids <br />due on October 8, 2020. Thirty contractors downloaded the project documents. Four proposals <br />were received and evaluated by a selection committee based on criteria as outlined in the RFP. <br />Listed below are the consultants selected for award and their ranking: <br />25D-1 <br />
