RESOLUTION NO. 2020-108 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DECLARING THE RESULTS OF THE <br />GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER <br />3, 2020. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Pursuant to the Charter of the City of Santa Ana, a general municipal election <br />was held in the City of Santa Ana on November 3, 2020, to fill the office of <br />Mayor and offices of members of the City Council nominated from Wards 1, 3 <br />and 5 of the City. <br />B. The results of the said election, including the whole number of votes cast in <br />the City, the names of the persons voted for, for what office each person was <br />voted for, and the number of votes given in the City to each person, are set <br />forth in the Certificate of Registrar of Voters to Result of the Canvass of the <br />General Election Returns attached hereto as Exhibit A and incorporated <br />herein by this reference as though fully set forth. <br />C. City Charter Section 406 provides that "[t]he City Council shall be the judge of <br />the election and qualifications of its members as defined in section 401 of this <br />charter and shall meet on the first regularly scheduled meeting after election <br />returns are certified for any municipal election at which members of the City <br />Council are elected, declare the results thereof, and installed elected <br />members, if any." <br />D. The City Council determines in accordance with Section 406 of the City <br />Charter that Vicente Sarmiento is entitled to hold the office of Mayor. The <br />City Council also declares Vicente Sarmiento elected to the office of Mayor of <br />the City of Santa Ana for a two-year term. <br />E. The City Council determines in accordance with Section 406 of the City <br />Charter that Thai Viet Phan is entitled to hold the office of Councilmember for <br />Ward 1. The City Council also declares Thai Viet Phan elected to the office <br />of Councilmember for Ward 1 of the City of Santa Ana for a four-year term. <br />F. The City Council determines in accordance with Section 406 of the City <br />Charter that Jessie Lopez is entitled to hold the office of Councilmember for <br />Resolution No. 2020-108 <br />Page 1 of 3 <br />
