Dedications and Street Improvements. <br />(a) Dedication of a 34-foot wide drainage and utility easement with <br />landscaping as shown on Exhibit 7 attached hereto and incorporated herein by this reference. <br />Developer, at a minimum, shall be responsible for replacement of the paving and improvements <br />within the Pedestrian Plaza as identified on the Site and Development Plan. <br />Prior to the issuance of a certificate of occupancy for the new parking structure, <br />Developer shall make the dedication described in subsection 7(a), above, and shall complete the <br />improvements listed in subsection 7(b), below, at Developer's sole cost. City and Developer <br />confirm that the improvements listed in subsections 7(b)(i), (ii), (iii) and (v), below have been <br />completed. City agrees to complete the update of the existing traffic signal timing and splits <br />described in subsection 7(c), below, at no cost to Developer. <br />(b) (i) Completion of abandonment and associated utility relocations for <br />Balser Street, Berkeley Street and Occidental Street, all as <br />described in Permit No. DP-2011-18 approved by the City on <br />July 12, 2018 with revisions approved September 6, 2018 and <br />August 12, 2019 (as approved and revised, "Permit DP-2011-18") <br />issued by City; <br />(ii) Completion of drainage improvements and storm drains all as <br />described in Permit No. PO108296 issued by City; <br />(iii) Modification of a four-way stop at the intersection of St. Andrew <br />Place and Baker Street all as described in Permit DP-2011-18 <br />issued by City; <br />(iv) Installation of a traffic signal and associated street improvements <br />at Bristol Street and St. Andrew Place in accordance with design <br />drawings prepared by Developer and approved by City; and <br />(v) Slurry seal and re -striping of St. Andrew Place between Bristol <br />Street and Baker Street, all as described in Permit DP-2011-18 <br />issued by City. <br />(c) Update the existing traffic signal timing and splits at the Edinger <br />Avenue/Monarch Way intersection to optimize and more efficiently allocate the signal green <br />times to each movement at the intersection. It is recommended/proposed that the left turn green <br />arrow into MDHS (onto Monarch Way) off of Edinger be split into a beginning and end of <br />sequence timing during peak traffic times at the beginning and end of the school day (8:15-9:00 <br />a.m. and 2:30-3:15 p.m.). <br />Site and Development Plan. <br />It is agreed by the parties hereto that the Master Plan Modification Site Plan prepared by <br />The Austin Company (Project No. 08-10167DO1) ), including the Preliminary Grading & <br />Drainage Plan, the Preliminary Wet Utility Plan, the Preliminary Dry Utility Plan, the Drainage <br />SMRH:4830-4678-6704.E -7- <br />
