CNA CNA PARAMOUNT <br />Employee Benefits Liability Coverage Part - Occurrence <br />2. errors in providing information on past performance of investment vehicles; or <br />3. advice given to any person with respect to that person's decision to participate or not to participate in any <br />plan included in the employee benefit program. <br />G. Insufficiency of Funds <br />any insufficiency of funds to meet any obligations under any plan included in the employee benefit program. <br />H. Workers' Compensation and Similar Laws <br />any failure to comply with the mandatory provisions of any workers' compensation, unemployment compensation <br />insurance, social security or disability benefits law or any similar law. <br />IV. LIMITS OF INSURANCE AND DEDUCTIBLE <br />A. Limits of Insurance <br />1. Related Claims <br />All related claims, whenever made, shall be considered a single claim first made during the policy period in <br />which the earliest claim was first made. <br />2. Limit of insurance — each employee <br />Subject to paragraph 2. below, the Insurer's limit of insurance for damages for all covered claims made by or <br />behalf of any one employee including such employee's dependents or beneficiaries, shall not exceed the <br />amount stated in the Coverage Part Declarations as "Employee Benefits Liability - each employee". <br />3. Limit of insurance - all claims in the aggregate <br />The Insurer's limit of insurance for damages for all covered claims shall not exceed the amount stated in the <br />Coverage Part Declarations as "Employee Benefits Liability — all claims in the aggregate", regardless of the <br />number of employees. <br />4. Multiple insureds, claims, and claimants <br />The limits of insurance shown in the Coverage Part Declarations and subject to the provisions of this policy, <br />is the most the Insurer will pay as damages regardless of the number of Insureds, claims made or reported, <br />persons or entities making claims, acts, errors or omission which result in damages or defense costs; <br />employee benefit plans. <br />B. Deductible <br />The Insurer's obligation to pay damages on behalf of the Insured applies only to the amount of damages in <br />excess of the deductible amount stated on the Coverage Part Declarations as applicable to each employee <br />including such employee's dependents or beneficiaries. The limits of insurance shall not be reduced by the <br />amount of this deductible. <br />The deductible amount stated on the Coverage Part Declarations applies to all damages sustained by any <br />one employee including such employee's dependents and beneficiaries, because of all acts, errors or <br />omissions to which this insurance applies. <br />The Insurer may pay any part or all of the deductible amount to effect settlement of any claim and, upon <br />notification of the action taken, the Insured shall promptly reimburse the Insurer for such part of the <br />deductible amount as the Insurer has paid. <br />The Limits of Insurance of this coverage part apply separately to each consecutive annual period and to any <br />remaining period of less than 12 months, starting with the beginning of the policy period shown in the Policy <br />Declarations, unless the policy period is extended after issuance for an additional period of less than 12 months.
