CNA CNA PARAMOUNT <br />Stop Gap Liability Coverage Part <br />Various provisions in this policy restrict coverage. Read the entire policy carefully to determine rights, duties and what is <br />and is not covered. <br />The word Insurer refers to the company providing this Insurance as set forth on the Policy Declarations. <br />I. COVERAGE <br />The Insurer will pay those sums up to the applicable limit of insurance that the Insured becomes legally obligated to <br />pay as damages because of bodily injury to an employee of the Named Insured provided that such employee has <br />been reported and declared under a Workers' Compensation Law of a state, territory or possession designated in <br />the Coverage Part Declarations prior to sustaining bodily injury, and such bodily injury: <br />A. is sustained by such employee and arises out of and in the course of such employee's employment; <br />B. takes place in the coverage territory; <br />C. is caused by: <br />1. an accident occurring during the policy period; or <br />2. a disease which is caused by or aggravated by conditions of such employee's employment. The employee's <br />last day of last exposure to the conditions causing or aggravating such bodily injury by disease must occur <br />during the policy period. <br />The Insurer will pay all defense costs in connection with a covered claim. Such defense costs are in addition to the <br />limits of insurance. <br />II. DEFENSE <br />A. Duty to Defend <br />The Insurer has the right and duty to defend in the Insured's name and on the Insured's behalf any covered suit <br />even if any of the allegations of such suit are groundless, false or fraudulent. The Insurer shall have the right to <br />appoint counsel and to make such investigation and settlement of a claim as is deemed necessary by the Insurer. <br />If a claim is subject to an arbitration proceeding or mediation proceeding, the Insurer shall be entitled to exercise <br />all of the Insured's rights in the choice of arbitrators or mediators and in the conduct of an arbitration proceeding <br />or mediation proceeding involving such claim. <br />B. Exhaustion of Limits <br />0 <br />N <br />s The Insurer is not obligated to investigate, defend, pay or settle, or continue to investigate, defend, pay or settle a <br />claim after the applicable limit of the Insurer's liability has been exhausted by payment of damages. In such <br />case, the Insurer shall have the right to withdraw from the further investigation, defense, payment or settlement of <br />such claim by tendering control of said investigation, defense or settlement of the claim to the Insured. <br />III. EXCLUSIONS <br />This insurance does not apply to bodily injury: <br />A. Age: <br />to an employee: <br />1. knowingly employed by the Named Insured in violation of any law as to age; or <br />2. under the age of 14 years, regardless of any such law. <br />B. Aircraft <br />arising out of aircraft operation or the performance of any duty in connection with aircraft while in flight. <br />C.
