CNA CNA PARAMOUNT <br />Stop Gap Liability Coverage Part <br />D. Failure to Comply <br />to an employee when the such employee is deprived of common law defenses or otherwise subject to penalty <br />because of the Named Insured's failure to secure its obligations under, or other failure to comply with, the <br />Workers' Compensation Law; <br />E. Intentionally Caused <br />intentionally caused or aggravated by the Named Insured, or resulting from an act which is determined to have <br />been committed by the Named Insured with the belief that bodily injury is substantially certain to occur; <br />F. Wrongful Employment Practices <br />arising out of coercion, criticism, demotion, evaluations, reassignment, discipline, defamation, harassment, <br />humiliation, discrimination against or termination of any employee, or personnel practices, policies, acts or <br />omissions. <br />IV. LIMITS OF INSURANCE <br />A. The Limits of Insurance shown in the Coverage Part Declarations and the rules below fix the most the Insurer will <br />pay regardless of the number of: <br />1. Insureds; <br />2. claims made; or <br />3. persons or organizations making claims or bringing suits. <br />B. Bodily injury by Accident. The limit shown under bodily injury by Accident— Each Accident in the Coverage <br />Part Declarations is the most the Insurer will pay for all damages because of bodily injury to one or more <br />employees in any one accident. <br />C. Bodily injury by Disease. The limit shown under bodily injury by Disease — Aggregate Limit in the Coverage <br />Part Declarations is the most the Insurer will pay all damages because of bodily injury by disease, regardless of <br />the number of employees who sustain bodily injury by disease. Bodily injury by disease does not include <br />disease that results directly from bodily injury by accident. <br />D. Bodily injury by Disease. Subject to Paragraph C. above, the limit shown under bodily injury by Disease — <br />Each employee in the Coverage Part Declarations is the most the Insurer will pay for all damages because of <br />bodily injury by disease to any one employee Bodily injury by disease does not include disease that results <br />directly from bodily injury by accident. <br />The limits of this Coverage part apply separately to each consecutive annual period and to any remaining period of <br />less than 12 months, starting with the beginning of the policy period shown in the Policy Declarations, unless the <br />policy period is extended after issuance for an additional period of less than 12 months. In that case, the additional <br />period will be deemed part of the last preceding period for purposes of determining the Limits of Insurance. <br />V. CONDITIONS <br />Assistance and Cooperation <br />If there is a claim, the Insured must: <br />A. forward to the Insurer or its designee, copies of the papers and documents, if any, which inform the Insured of a <br />claim, including all notices, summonses or other processes regarding legal proceedings; <br />B. fully cooperate with the Insurer or its designee in all investigations, the making of settlements, the conduct of suits <br />or other proceedings, enforcing any right of contribution or indemnity against another who may be liable to the <br />Insured because of the claim.
