CNA CNA PARAMOUNT <br />Stop Gap Liability Coverage Part <br />The due date for audit and retrospective premiums is the date shown as the due date on the bill. If the sum of the <br />advance and audit premiums paid for the policy term is greater than the earned premium, the Insurer will return <br />the excess to the first Named Insured. <br />C. The First Named Insured must keep records of the information the Insurer need for premium computation, and <br />send the Insurer copies at such times as the Insurer may request. <br />Separation of Insureds <br />Except with respect to the Limits of Insurance, and any rights or duties specifically assigned in this coverage part to <br />the First Named Insured, this insurance applies: <br />A. as if each Named Insured were the only Named Insured; and <br />B. separately to each Insured against whom a claim is made. <br />Transfer of Rights of Recovery <br />If any Insured for whom payment is made by the Insurer under this policy has rights to recover amounts from another, <br />those rights are transferred to the Insurer to the extent of its payment. The Insured must do everything necessary <br />after loss to secure the Insurer's rights and must do nothing to prejudice such rights. <br />VI. DEFINITIONS <br />Authorized Insured means any executive officer, member of the Named Insured's human resources, risk <br />management or in-house general counsel's office, or any employee authorized by the Named Insured to give or <br />receive notice of a claim. <br />Bodily injury means physical injury, sickness or disease sustained by a person, including death resulting from any of <br />these at any time. <br />Coverage Part means only those coverage parts designated as included in the Schedule of Forms and <br />Endorsements. <br />Coverage territory means: <br />A. the United States of America (including its territories and possessions), Puerto Rico and Canada; and <br />B. international waters or airspace, but only if the bodily injury occurs in the course of travel or transportation <br />between any places included in Paragraph A. above. <br />Claim means: <br />A. suit; or <br />B. a written or oral demand for damages, <br />alleging bodily injury to an employee. <br />Damages means the amount an Insured is legally obligated to pay, either through: <br />A. final adjudication of a covered claim; or <br />B. through compromise or settlement of a covered claim with the Insurer's written consent or direction; <br />Including those amounts for which an Insured is liable pursuant to A. and B. above: <br />1. that an Insured must pay for care, loss of services and death resulting at any time from the bodily injury; <br />and <br />2. for which the Named Insured is liable to a third party by reason of a claim against the Named Insured by <br />that third party to recover the damages claimed against such third party as a result of injury to the Named <br />Insured's employee; <br />CNA74934XX 01-15 <br />Copyright CNA All Rights Reserved. <br />�oRaN <br />RiskMmRgemerttDiAsfan <br />REVIEWED & APPROVED BY.- <br />ql <br />s.r; s.e PZ.
