CNA CNA PARAMOUNT <br />Stop Gap Liability Coverage Part <br />in connection with consequential bodily injury to a spouse, child, parent, brother or sister of the injured <br />employee; provided that such amounts are the direct consequence of bodily injury that arises out of and in <br />the course of the injured employee's employment by the Named Insured <br />4. that arise out of and in the course of employment, where the claim alleging such bodily injury is made <br />against the Named Insured in a capacity other than as employer. <br />In addition, damages includes the above -mentioned sums only after deducting all other recoveries and salvages. <br />However, damages does not include: <br />a. the multiplied portion of multiplied awards imposed pursuant to any statute or regulation requiring such <br />awards; or <br />b. any premium, assessment, penalty, fine, benefit, liability or other obligation imposed by: <br />i. The Federal Employer's Liability Act (45 USC Sections 51-60); <br />ii. The Non -appropriated Fund Instrumentalities Act (5 USC Sections 8171-8173); <br />iii. The Longshore and Harbor Workers' Compensation Act (33 USC Sections 910-950); <br />iv. The Outer Continental Shelf Lands Act (43 USC Sections 1331-1356); <br />v. The Defense Base Act (42 USC Sections 1651-1654); <br />vi. The Federal Coal Mine Health and Safety Act of 1969 (30 USC Sections 901-942); <br />vii. The Migrant and Seasonal Agricultural Worker Protection Act (29 USC Sections 1801-1872); and <br />viii. Any other Workers' Compensation, unemployment compensation or disability laws or any similar law <br />Defense costs mean: <br />A. reasonable and necessary fees, costs, and expenses incurred by the Insurer or consented to by the Insurer and <br />incurred by the Named Insured in the defense or appeal of a covered suit or in the investigation of any covered <br />claim, and includes premium for appeal bonds arising out of a covered judgment, attachment bonds or similar <br />bonds, but only for bond amounts up to the applicable limit of insurance. <br />B. prejudgment interest awarded against an Insured on that part of a judgment covered by this coverage part. If the <br />Insurer makers an offer to pay the applicable limit of insurance, the Insurer will not pay any prejudgment interest <br />based on that period of time after the offer. <br />N <br />r <br />C. post judgment interest which accrues after entry of judgment, but before the Insurer has paid or offered to pay, <br />or deposited in court that part of the judgment which is within the applicable limit of insurance of this coverage <br />part. The amount of interest the Insurer pays will be in direct proportion to the amount of damages the Insurer <br />pays in relation to the total amount of the judgment. <br />D. all reasonable expenses incurred by a natural person Insured at the Insurer's request to assist the Insurer <br />in the investigation or defense of the claim. This includes such Insured's actual loss of earnings up to <br />$1000.00 per day, because of time off from work; <br />E. all court costs taxed against the Insured in the suit.
