DNA <br />do so only until the Insurer: <br />1. makes payment of; or <br />2. offers to pay; or <br />3. deposits in court <br />CNA Paramount Excess and Umbrella Liability <br />Policy <br />that part of a judgment up to but not exceeding the Insurer's applicable limits of insurance. <br />E. No Insured shall admit liability, consent to any judgment, agree to any settlement or make any <br />settlement offer which is reasonably likely to involve this Policy without the Insurer's prior written <br />consent, such consent not to be unreasonably withheld. The Insureds agree that they shall not <br />knowingly take any action that increases the Insurer's exposure for damages or defense costs under <br />this Policy. <br />III. EXCLUSIONS <br />A. Coverage A - Excess Follow Form Liability and Coverage B - Umbrella Liability Exclusions <br />With respect to both the Coverage A- Excess Follow Form Liability and Coverage B -Umbrella Liability, <br />this Insurance does not apply to: <br />1. Access to or Disclosure of Confidential or Personal Information and Data -Related Liability <br />any actual or alleged damages arising out of: <br />a. any access to or disclosure of any person's or organization's confidential or personal <br />information, including patents, trade secrets, processing methods, customer lists, financial <br />information, credit card information, health information or any other type of nonpublic <br />information; or <br />b. the loss of, loss of use of, damage to, corruption of, inability to access, or inability to <br />manipulate electronic data. <br />This exclusion applies even if damages are claimed for notification costs, credit monitoring <br />expenses, forensic expenses, public relations expenses or any other loss, cost or expense incurred <br />by the Named Insured or others arising out of that which is described in paragraph a. or b. above. <br />However, unless paragraph a. above applies, this exclusion does not apply to bodily injury to the <br />extent that such liability is covered by underlying insurance. <br />2. Asbestos <br />any actual or alleged liability arising out of the actual, alleged or threatened exposure at any time <br />to asbestos; or <br />b. any actual or alleged loss, cost or expense that may be awarded or incurred: <br />i. by reason of a claim for any such injury or damage; or <br />ii. in complying with a governmental direction or request to test for, monitor, clean up, <br />remove, contain or dispose of asbestos. <br />3.
