CNA CNA Paramount Excess and Umbrella Liability <br />Policy <br />This exclusion applies: <br />i. whether an Insured may be liable as an employer or in any other capacity; and <br />ii. to any obligation to share damages with or repay someone else who must pay damages <br />because of the injury. <br />This exclusion does not apply to liability assumed by the Insured under an insured contract. <br />7. Expected or Intended injury <br />any actual or alleged bodily injury or property damage arising out of an act or omission: <br />a. intended by an Insured; or <br />b. that would be expected from the standpoint of a reasonable person in the circumstances of the <br />Insured; <br />to cause bodily injury or property damage, even if the actual bodily injury or property damage is of a <br />different degree or type than intended or expected. <br />This exclusion does not apply to bodily injury or property damage resulting from the use of <br />reasonable force to protect persons or property. <br />8. Fungi or Other Organic Pathogens <br />a. any actual or alleged bodily injury, property damage or personal and advertising injury arising <br />out of any actual, alleged or threatened inhalation of, ingestion of, contact with, exposure to, <br />existence of, or growth or presence of any fungi or other organic pathogens; <br />b. any actual or alleged loss, cost or expense arising out of or relating to the testing for, <br />monitoring, cleaning up, removing, containing, treating, detoxifying, neutralizing, remediating,or <br />disposing of, or in any way responding to or assessing the effects of fungi or other organic <br />pathogens by any Insured or by anyone else; or <br />c. any actual or alleged property damage caused by water where there also exists any property <br />damage arising out of or relating to, in whole or in part, the actual, alleged or threatened <br />inhalation of, ingestion of, contact with, exposure to, existence of, or growth or presence of <br />any fungi or other organic pathogens. <br />This exclusion applies regardless of any other cause or event that contributes concurrently or in any <br />sequence to such injury or damage, loss, cost or expense. <br />9.
