CNA CNA Paramount Excess and Umbrella Liability <br />Policy <br />ii. providing or failing to provide transportation with respect to any person that may be under the <br />influence of alcohol, <br />if the occurrence which caused the bodily injury or property damage involved that which is <br />described in paragraph a., b. or c. above. <br />10. Nonemployment Related Discrimination <br />any actual or alleged personal and advertising injury arising out of any actual or alleged <br />nonemployment related discrimination committed intentionally against a person. <br />11. Personal and Advertising Injury <br />any actual or alleged personal and advertising injury: <br />a. Breach of Contract <br />arising out of breach of contract, except an implied contract to use another's advertising idea in <br />the Named Insured's advertisement. <br />b. Criminal Acts or Conduct <br />arising out of any actual or alleged criminal act or omission committed by or at the direction of <br />any Insured. This exclusion does not apply to the extent liability is imposed upon the Insured <br />for acts or omissions of another committed without the knowledge or consent of the Insured. <br />c. Electronic Chat Rooms or Bulletin Boards <br />arising out of an electronic chat room or bulletin board the Insured hosts, owns, or over which <br />the Insured exercises control. <br />d. Infringement of Copyright, Patent, Trademark or Trade Secret <br />arising out of infringement of copyright, patent, trademark, trade secret or other intellectual <br />property rights. Under this exclusion, such other intellectual property rights do not include the <br />use of another's advertising idea in the Named Insured's advertisement. However, this exclusion <br />does not apply to infringement of copyright, trade dress or slogan in the Named Insured's <br />advertisement. <br />e. Insureds in Media and Internet Type Businesses <br />committed by an Insured whose business is: <br />i. advertising, broadcasting, publishing or telecasting; <br />ii. designing or determining content or web -sites for others; or <br />iii. an Internet search, access, content or service provider. <br />However, this exclusion does not apply to paragraph A., B. or C. of personal and advertising <br />injury as defined in the section entitled Definitions. <br />For the purposes of this exclusion, the placing of frames, borders or links, or advertising, for the <br />Named Insured or others anywhere on the Internet, is not by itself, considered the business of <br />advertising, broadcasting, publishing or telecasting. <br />f.
