DNA <br />g. Material Published Prior To Policy Period <br />CNA Paramount Excess and Umbrella Liability <br />Policy <br />arising out of oral or written publication, in any manner, of material whose first publication took <br />place before the beginning of the policy period. <br />h. Material Published with Knowledge of Falsity <br />arising out of written publication in any manner of material, if the Insured knew or should have <br />known the material was false. <br />i. Quality or Performance of Goods — Failure to Conform to Statements <br />arising out of any failure of goods, products or services to conform to any statement of quality <br />or performance made in the Named Insured's advertisement. <br />j. Unauthorized Use of Another's Name or Product <br />arising out of unauthorized use of another's name or product in the Named Insured's e-mail <br />address, domain name or metatag, or any other similar tactics to mislead another's potential <br />customers. <br />k. Wrong Description of Prices <br />arising out of the wrong description of the price of goods, products or services stated in the <br />Named Insured's advertisement. <br />12. Pollution <br />a any actual or alleged bodily injury, property damage or personal and advertising injury arisingout <br />of the actual, alleged or threatened discharge, dispersal, seepage, migration, release or escape <br />of pollutants at any time. <br />b. any actual or alleged loss, cost or expense arising out of any: <br />i. request, demand, order, or statutory or regulatory requirement that anyone test for, monitor, <br />clean up, remove, contain, treat, detoxify or neutralize, or in any way respond to or assess <br />the effects of pollutants; or <br />ii. claim by or on behalf of a governmental authority for damages because of testing for, <br />monitoring, cleaning up, removing, containing, treating, detoxifying or neutralizing, or in any <br />way responding to or assessing the effects of pollutants. <br />13. Silica <br />a. any actual or alleged bodily injury arising, in whole or in part, out of the actual, alleged or <br />threatened respiration or ingestion at any time of silica; or <br />b. any actual or alleged property damage arising in whole or in part out of the actual, alleged or <br />threatened presence of silica. <br />c. any actual or alleged personal and advertising injury arising, in whole or in part, out of the <br />actual, alleged or threatened: <br />i. exposure at any time to; or <br />ii. presence at any time of; <br />silica. <br />14.
