Coordinator or the applicable Campus <br />President/Executive Director becomes aware of a <br />Sexual Harassment report. <br />Education program or activity: On or off campus <br />locations, events or circumstances over which the <br />school exercises substantial control over both the <br />Respondent and the context in which the Sexual <br />Harassment occurred. <br />Policies and Procedures <br />1. Title IX Policy Statement <br />UEI strictly prohibits Sexual Harassment and <br />retaliation against any person who reports Sexual <br />Harassment or participates (or refuses to <br />participate) in any Title IX grievance process <br />under this policy. <br />UEI will respond to a report of Sexual <br />Harassment when it (1) has actual knowledge of <br />Sexual Harassment; (2) that occurred within an <br />applicable school's education program or activity; <br />(3) against a person in the United States. <br />If the alleged conduct does not constitute Sexual <br />Harassment, the school may investigate the <br />concern as required by the Student <br />Complaint/Grievance Procedure Policy outlined <br />in this school catalog and/or the Complaint <br />Procedure Policy outlined in the Team Member <br />Handbook. <br />2. Title IX Coordinator <br />UEI's Title IX Coordinator oversees compliance <br />with all aspects of this policy and is designated by <br />UEI to intake reports and Formal Complaints of <br />Sexual Harassment, provide supportive <br />measures, and investigate alleged Sexual <br />Harassment. A report can be made at any time, <br />including during non -business hours. However, <br />responses to reports made outside of business <br />hours, including during weekends and holidays, <br />may be delayed. <br />3. Supportive Measures <br />Supportive measures are individualized services <br />reasonably available to ensure equal educational <br />access, protect safety or deter Sexual <br />Harassment. Supportive Measures are available, <br />as appropriate, to the Complainant and <br />Respondent and are non -punitive, non - <br />disciplinary and not unreasonably burdensome to <br />the other party. <br />Upon receiving a report of Sexual Harassment, <br />the Title IX Coordinator will promptly contact the <br />Complainant confidentially to discuss the <br />availability of supportive measures. The Title IX <br />Coordinator shall notify the Complainant that <br />supportive measures are available regardless of <br />whether a Formal Complaint is filed and explain <br />to the Complainant the process for filing a Formal <br />Complaint, <br />Supportive Measures are individualized and <br />appropriate based on the information gathered by <br />the Title IX Coordinator. The Supportive <br />Measures needed by the Complainant and/or <br />Respondent may change over time, and the Title <br />IX Coordinator will communicate with each party <br />to ensure that any Supportive Measures are <br />necessary and effective based on evolving <br />needs. <br />Supportive measures will be provided without fee <br />or charge and may include: <br />• Counseling; <br />• Extending deadlines; <br />• Modifying class or work schedules; <br />• Placing mutual restrictions on contact <br />between the parties; <br />• Providing campus escort services; <br />• Changing work locations; and <br />• Providing leaves of absence. <br />4. Formal Complaint <br />UEI utilizes a prompt, equitable and impartial <br />grievance process to evaluate Formal <br />Complaints of Sexual Harassment, which may be <br />filed by a Complainant or by UEI's Title IX <br />Coordinator. A Formal Complaint is a document <br />(hardcopy or electronic) filed by a Complainant or <br />signed by the Title IX Coordinator alleging Sexual <br />Harassment against a Respondent and <br />requesting that the school investigate. A Formal <br />Complaint must be signed (physical or digital) by <br />the Complainant, the Title IX Coordinator or <br />otherwise indicate that that Complainant is the <br />person filing the Formal Complaint.
