6. Education Program or Activity: all academic, educational,
<br />extracurricular, athletic, and other programs of Concorde occurring
<br />in the U.S., including locations or events, or circumstances over
<br />which the College exercised substantial control over both the
<br />Respondent and the context in which the sexual discrimination or
<br />harassment occurs, and also includes buildings owned or
<br />controlled by student organization that is officially recognized by
<br />Concorde.
<br />7. Grievance Procedures: Procedures adopted and published by
<br />Concorde as set forth as in this policy.
<br />8. "in Writing": Use of the phrase "in writing" shall refer to
<br />submission of materials either electronically (e.g., via email or via
<br />hard copy format, sent via facsimile, U.S. mail or courier service,
<br />interoffice mail, or personal delivery) to the Lead Title IX
<br />coordinator.
<br />9. Supportive Measures: Non -disciplinary, non -punitive
<br />individualized services offered as appropriate, as reasonably
<br />available, and without a fee or charge after Concorde obtains
<br />Actual Knowledge that Prohibited Conduct may have occurred,
<br />including but not limited to before or after the filing of a Formal
<br />Complaint. Supportive Measures must be available to
<br />Complainantsand Respondents on an equitable basis and must be
<br />designed to:
<br />i. restore or preserve equal access to Concorde's
<br />education programs or activities without unreasonably
<br />burdening the other party;
<br />J. protect the safety of all parties and the College's
<br />educational environment; and
<br />Ill. deter Prohibited Conduct.
<br />10. Prohibited Conduct: Sex Discrimination and Sexual Harassment as
<br />defined in Title IX of the Education Amendments of 1972 (20 U.S.C.
<br />§§ 1681, et. seq.) and its implementing regulations (34 CFR 106, at.
<br />seq.) and the Title IX policy 04-018.
<br />11. Remedies: Actions taken to restore or preserve equal access to
<br />Concorde's education programs and activities.
<br />12. Respondent: Person(s) reported to have engaged in Prohibited
<br />Conduct. A person may be a complainant, or a respondent, even
<br />where no formal complaint has been filed and no grievance process
<br />is pending.
<br />Student Computer Network and
<br />Internet Conduct
<br />Concorde Career College provides students access to its computer network
<br />and Internet access for purposes directly related to education. Concorde
<br />reserves the right to monitor all usage of its computers and computer
<br />systems. This includes the monitoring of email and website access. The
<br />following practices are prohibited:
<br />• Installing or executing unauthorized software. Using computers to copy
<br />copyrighted or licensed software.
<br />• Using the network for commercial purposes. Users may not buy or sell
<br />products or services through the system without prior consent of the
<br />corporate network administrator.
<br />• Using the network for any activity or to transmit any material that violates
<br />federal, state, or local laws. This includes, but is not limited to, illegal
<br />activities, such as threatening the safety of another person or peer -to -peer
<br />file sharing of copyrighted materials.
<br />• Using vulgar, derogatory, or obscene language. Users may not engage in
<br />personal attacks, harass another person, or post private information about
<br />another person.
<br />• Logging on to another person's account or attempting to access another
<br />user's files, with or without that person's permission.
<br />• "Hacking" or otherwise trying to gain access to another person's or
<br />organization's computer system.
<br />• Engaging in "spamming" (sending an email to more than 10 people at the
<br />same time) or participation in chain letters.
<br />• Intentionally damaging any computer hardware or software.
<br />Computer and network resources are of significant value, and their abuse
<br />can have a negative effect on other users. Noncompliance with this policy
<br />may result in loss of computer and network privileges, suspension, and/or
<br />withdrawal from school.
<br />Social Media Use Policy
<br />This policy addresses the use of social media sites by Concorde students,
<br />whether or not the use involves the College's WiFi network or other
<br />computer resources. Social media includes, but is not limited to: testing,
<br />blogs and social media platforms such as Snapchat, Twitter, Facebook,
<br />Unkedln, Instagram, Google+, YouTube, Hirst, and Yammer.
<br />Concorde is aware that members of the College community may wish to
<br />express their personal ideas, thoughts, and opinions through their private
<br />social media accounts (not administered by the College). Nevertheless,
<br />Concorde students are expected to conduct themselves in a professional
<br />manner at all times. Concorde reserves the right, under circumstances it
<br />deems appropriate and subject to applicable laws and regulations, to impose
<br />disciplinary measures. Such disciplinary measures Include dismissal from the
<br />College for students who use social media in violation of the guidelines in this
<br />policy, in ways that reflect poorly on the College, or interferes with the
<br />education of other students and/or the operation of the College, In
<br />appropriate cases, the conduct may also be reported to law enforcement
<br />authorities.
<br />In connection with the use of social media, the conduct listed below is
<br />prohibited:
<br />• Using social media to harass, threaten, insult, defame or bully another
<br />person or entity.
<br />• Making threats of injury to any student, patient, member of faculty or staff,
<br />or officer or board member, including threats concerning their respective
<br />family members or personal property.
<br />• Using the network for advertising or political lobbying.
<br />• Making comments that insult, disparage, disrespect or defame the College
<br />• Accessing websites,newsgroups, or chat areas that contain material that is or members of the Concorde community.
<br />sexually related, obscene, or that promotes illegal acts. If a user accidentally
<br />accesses this type of information, he or she should immediately notify an ° Making discriminatory or harassing comments that violate federal or state
<br />instructor, the Learning Resource Center Coordinator, and/or network law and/or would be prohibited by Concorde's anti -discrimination / anti -
<br />administrator. harassment policy and/or Title IX policy.
