C-1-3289 <br />the CITIES of Fountain Valley and Santa Ana. <br />B. The CITY of Fountain Valley shall include the mitigation improvement(s) in their next future <br />CIP with an option to modify any future CIP, as needed. Improvement 1 will be pursued once the LOS <br />reaches the pre -amendment MPAH ICU LOS of 0.99, E. If deemed necessary by the <br />CITY of Fountain Valley, Improvement 2a or 2b may be selected within ten (10) years of completion of <br />Improvement 1 <br />C. The CITY of Fountain Valley shall utilize funding provided by the CITY of Santa Ana to <br />implement the mitigation improvement(s). <br />ARTICLE 6. RESPONSIBILITIES OF THE CITY OF TUSTIN: <br />The CITY of Tustin agrees to the following responsibilities: <br />A. The CITY of Tustin enters into this MOU to implement the proposed mitigation <br />improvement measure at the Red Hill Avenue and Warner Avenue intersection, as identified in Exhibit D. <br />The improvement is not meant to be prescriptive. If an alternative improvement, which meets the overall <br />objective of achieving and/or maintaining the pre -amendment to the MPAH ICU, is identified then that <br />improvement shall be considered acceptable and shall be implemented as a substituted solution if there <br />is agreement amongst the CITIES of Tustin and Santa Ana. <br />B. The CITY of Tustin shall include the mitigation improvement in their next future CIP with <br />an option to modify any future CIP, as needed. The improvement should be implemented prior to the <br />intersection reaching the pre -amendment to the MPAH ICU LOS of 0.88, D as shown in Exhibit D. <br />C. The CITY of Tustin shall utilize funding provided by the CITY of Santa Ana to implement <br />the mitigation improvement. <br />ARTICLE 7. DELEGATED AUTHORITY: <br />The actions required to be taken by the CITIES in the implementation of this MOU are delegated <br />to each CITY's City Manager, or designee. Required actions to be taken by AUTHORITY in the <br />implementation of this MOU are delegated to AUTHORITY's Chief Executive Officer, or designee. <br />Page 10 of 16 <br />
