(on) The City of Santa Ana finds that the protections provided in this Ordinance are more <br />restrictive, or provide greater benefits, than those set forth in California Civil Code sections <br />1946.2 and 1947.12, in areas relating to annual rent increases, evictions, relocation assistance for <br />displaced Tenants, protection against harassment, discrimination of Tenants and residential <br />applicants. The Ordinance further provides other Tenant protections not subject to preemption or <br />otherwise precluded by any other provision of law. <br />(vv) Because of the numerous concerns noted herein related to the adverse impacts that result <br />from a lack of affordable housing within the City of Santa Ana, the People of the City of Santa <br />Ana determine that it is in the interest of its residents to preserve the public health, safety and <br />general welfare to adopt this Ordinance. Accordingly, the People of Santa Ana seek to put into <br />place, among other things, just cause for eviction, rent stabilization, and a process to resolve <br />disputes between landlords and tenants and to ensure that landlords continue to receive a fair rate <br />of return. <br />SECTION 3 Definitions <br />Unless further defined elsewhere in this Chapter, the following words or phrases as used in this <br />Chapter shall have the meaning provided below when used in this Chapter whether plural or <br />singular: <br />(a) Annual General Adjustment. The Annual General Adjustment is the percentage by which <br />the Rent for existing tenancies in Covered Rental Units may be increased each year, subject to <br />the limitations of this Chapter. <br />(b) Base Rent. The Base Rent is the reference point from which the lawful Rent shall be <br />determined and adjusted in accordance with this Chapter. <br />(1) Tenancies commencing on or before February 25, 2020. The Base Rent for tenancies <br />that commenced on or before February 25, 2020, shall be the Rent in effect on February <br />25, 2020. <br />(2) Tenancies commencing after February 25, 2020. The Base Rent for tenancies that <br />commenced after February 25, 2020, shall be the initial rental rate charged upon initial <br />occupancy, provided that amount is not a violation of this Chapter or any provision of <br />state law. The term "initial rental rate" means only the amount of Rent actually paid by <br />the Tenant for the initial tern of the tenancy. <br />(c) Buyout Agreement. A written agreement where a Landlord pays a Tenant money or offers <br />other consideration to voluntarily vacate a Rental Unit covered by this Chapter. The term <br />"Buyout Agreement" includes an agreement to settle a pending unlawful detainer action if the <br />15 <br />
