action was filed within 120 days after Buyout Negotiations commenced. In all other instances, an <br />agreement to settle a pending unlawful detainer action shall not be a "Buyout Agreement." <br />(d) Buyout Negotiations. Any discussion or bargaining, whether oral or written, between a <br />landlord and tenant regarding the possibility of entering into a Buyout Agreement. <br />(e) Buyout Offer. An offer, written or oral, by a Landlord to a Tenant to pay money or other <br />consideration to vacate a Rental Unit covered by this Chapter. <br />(f) Change of Use. A Use of the Park for a purpose other than the rental, or the holding out for <br />rent, of two or more Mobilehome sites to accommodate Mobilehomes used for human habitation, <br />and does not mean the adoption, amendment, or repeal of a Park rule or regulation. A Change of <br />Use may affect an entire Park or any portion thereof and includes conversion to a condominium, <br />stock cooperative, planned unit development, or any form of ownership wherein spaces within <br />the park are to be sold. <br />(g) City Council. The City Council of the City of Santa Ana. <br />(h) Comparable Housing. Housing in an apartment complex or condominium that is similar in <br />size, number of bedrooms and amenities to the Mobilehome that is being displaced and is located <br />in a community that has similar access to community amenities such as shopping, medical <br />services, recreational facilities, schools, and transportation, or a comparable Mobilehome in a <br />Comparable Mobilehome Park. <br />(i) Comparable Mobilehome Park. A Mobilehome Park that is similar in condition, age, size, <br />and amenities to the Mobilehome Park that is being closed and is located within a community <br />similar to that in which the Mobilehome Park that is being closed is located and has similar <br />access to community amenities such as shopping, medical services, recreational facilities, <br />schools, and transportation. <br />0) Covered Rental Unit. All Rental Units not specifically exempted under Section 4 <br />(Exemptions — Fully Exempt) or Section 5 (Additional Homeowner Protections) herein, or <br />California Civil Code Section 1954.52, as may be amended. <br />(k) Custodial Relationship. With respect to a child and a Tenant/Resident, that the <br />Tenant/Resident is the legal guardian of the child, or has a court -recognized caregiver <br />authorization affidavit for the child, or has provided full-time custodial care of the child pursuant <br />to an agreement with the child's legal guardian or court -recognized caregiver and has been <br />providing that care for at least one year or half of the child's lifetime, whichever is less. <br />16 <br />
