EXHIBIT 3 <br />requirement of the Project. Subject to applicable laws and regulations gnvening <br />nondiscnnination and prelerenceS in housing occupancy required by HUD or the Slate of <br />Califontia, as well as the City of Santa Ana Allordablc llousiug Funds Policies and <br />Procedures, the Developer shall give preference in leasing units in the following order of <br />priority: <br />1. First prioril_v shall be given to persons who have been permanently displaced or <br />face permanent displacement from housing in Santa Ana as a result of airy of the <br />following: <br />a. A redevelopment prgject undertaken pursuant to California's Camrnunily <br />Redevelopment Law (Health & Safety Code Sections 3M00, et seq.) -- <br />applicable only to projects ltmded by the Low and Moderate Income <br />Housing Assct Fund. <br />b. Ellis Act, owner -occupancy, or removal permit eviction; <br />e. Earlhquake, lire, flood, or other natural disaster; <br />d. Cancellation of a TTousing Choice Voucher TTAT' Contract by property <br />owner; or <br />e. Governmental Action, such as Code ILntorecment. <br />2. Second priority shall be given to persons who are either <br />a. Residents of Santa Ana and/or <br />Working in Santa Ana at least 32 hours per week for at least the last (i <br />tnonlhs. <br />11.4 Handicapped Accessibility. Developer shall comply with (a) Section <br />504 of the Rehabilitation Act of 1973, and implementing regulations at 24 CI-R Part 8 <br />governing accessibility ofprojecls assisted under the CDR(3 Program; and (h) the <br />Americans with Disabilities Act of 1990, and inplcancming regulations at 28 CFR Parts <br />35-30, its applicable in order to provide handicapped accessibility to the extent readily <br />achievable. <br />11.5 Use of Debarred. Suspended, or Ineligible I'll •ticipants. Developer shall <br />comply with the provisions ol'24 CFR Part 5 relating to the eiriployrnem, engagement of' <br />services, awarding of contracts, or fitnding of any contractor or sttbcontntctor during, any <br />period of debarment, suspension, or placement in ineligibility status. Developer shall <br />maintain documentation verilying perlormalice of clearance reviews through the General <br />Services Administration — System for Award Management (SAM), dated prior to the <br />enrplo-vment, engagenu:nt of services, awarding of conoracts, or funding of any conuractor <br />or. subcontractor. <br />City Council -)1 21 — 25 4/20/2021 <br />
