Subject to applicable laws and regulations guvernin- nundic;uuninatiun <br />and preferences in housing occupancy required by HUD or the State (it California, as well <br />as the City of Santa Ana Affordable Housing Funds Policies and Procedures, the <br />Developer shall give preference in leasing units in the till lowing order ofprioniy! <br />First priority shall be given to persons who have been <br />permanently displaced or face permanent displacement front <br />housing in Santa Ana as a result of any of the following: <br />a. A redeveluptnent project tmdertaken pursuant to <br />Califurim's Community Redevelopment Law (I lealth & <br />Safety Code Sections 33000, et seq.) -- applicable only <br />to projects funded by the I -ow ,tnd Moderate Income <br />TTousing Asset Fund- <br />b. Ellis Act, owner -occupancy, or removal permit eviction; <br />c- Earthquake, fire, flood, or other natural disaster; <br />d. Cancellation of a I iuusing Chuicc VUtlelter I IAP <br />Contract by property owner; or <br />e- Govenunental Action, such as Code Entbrcenlent- <br />it. Second priority shall be given to persons who are either: <br />a- T2esidents of tianta Ana and/or <br />b. Working in Santa Ana at least 32 hours per week for at <br />least the last 6 months. <br />; and <br />(f) C `any Out the Affirmative Marketing procedures of the City of Santa <br />Ana, which are designed to provide intormation and otherwise aurae[ cligifile persons <br />from all racial, ethnic and gender groups in the housing market area to the units. <br />Developer shall Cooperate with the City to effectuate this provision prior to the initial <br />renting, w- upon occun-ence of a vacancy, and the re -renting of any Restricted Units (24 <br />CFR 92351)- <br />6. 1lousint-, Choice Voucher Program. Developer, its successors and <br />assigns, shall not reluse to lease a unit to a holder ofa renal voucher under 24 CF R part <br />982 (Housing Choice Voucher Program) or to a holder of a comparable document <br />evidencing participation in a HOME tenant -based assistance program bCCauSe of the starts <br />of the prospective tenant as a holder of such certificate of family participation, rental <br />voucher, or comparable 11OME tenant -based assistance document.
