This endorsement modifies insurance provided under the following: <br />SPECIFIED PROFESSIONS PROFESSIONAL LIABILITY <br />PRIVACY BREACH EXPENSE AND DEFENSE OF REGULATORY <br />CLAIMS ENDORSEMENT <br />Unless otherwise stated herein, the terms, conditions, exclusions and other limitations set forth in <br />this endorsement are solely applicable to coverage afforded by this endorsement. This <br />endorsement is part of and subject to the provisions of the Policy to which it is attached. <br />I. COVERAGES <br />Words shown in bold shall have the meaning provided <br />in Section II. DEFINITIONS of this endorsement or as <br />provided in the SPECIFIED PROFESSIONS <br />PROFESSIONAL LIABILITY COVERAGE FORM, <br />SECTION Ill. DEFINITIONS, as applicable. <br />Privacy Breach Expense The Company will pay on behalf of the Named <br />Insured or its Subsidiary, as applicable, for Privacy <br />Breach Expense. Any Privacy Breach must first occur <br />on or after the Retroactive Date and be first discovered <br />by an Insured during the Policy Period and reported to <br />the Company during the Notice Period. <br />The Insured shall not incur any Privacy Breach <br />Expense without (1) first reporting the Privacy Breach <br />to the Company and (2) using a service provider of the <br />Company's choice. <br />Defense of Regulatory Claims The Company will pay on behalf of the Insured, Claim <br />Expenses resulting from a Claim first made against an <br />Insured during the Policy Period or, if applicable, <br />during any Extended Reporting Period for a Regulatory <br />Wrongful Act. Such Regulatory Wrongful Act must <br />first occur on or after the Retroactive Date. The <br />Company will also pay fines and penalties to the extent <br />insurable by law which the Insured is legally obligated <br />to pay, including amounts the Insured is legally <br />obligated to deposit in a fund as equitable relief for the <br />payment of consumer claims, resulting from a <br />Regulatory Notice/Proceeding alleging a Regulatory <br />Wrongful Act. <br />II. <br />SP 298 (12-17) <br />For purposes of coverage provided under this <br />RAMuuganerdINslon <br />Rwe&m n A"wvm Br. <br />�� Risk Management Analyst <br />
