ARTICLE 8 <br />RECORDS, REPORTS AND INFORMATION REQUIREMENTS <br />8.1 General <br />Contractor shall maintain such accounting, statistical and other records related to its <br />performance under this Agreement as shall be necessary to develop the financial <br />statements and other reports required by this Agreement. Also, Contractor agrees to <br />conduct data collection, information and record keeping, and reporting activities <br />needed to comply with Applicable Laws and regulation and to meet the reporting and <br />Solid Waste program management needs of City. To this extent, such requirements set <br />out in this and other Articles of this Agreement shall not be considered limiting or <br />necessarily complete. In particular, this Article is intended to only highlight the general <br />nature of records and reports and is not meant to define exactly what the records and <br />reports are to be and their content. Further, with the written direction or approval of <br />City, the records and reports to be maintained and provided by Contractor in <br />accordance with this and other Articles of the Agreement shall be adjusted in number, <br />format, or frequency. <br />8.2 Records <br />8.2.1 General <br />Contractor shall maintain records required to conduct its operations, to support <br />requests it may make to City, and to respond to requests from City in the conduct of <br />City business. Adequate record security shall be maintained to preserve records from <br />events that can be reasonably anticipated such as a fire, theft and earthquake. <br />Electronically maintained data/records shall be protected and backed up. All records <br />shall be maintained for five (5) years, and shall continue to be available for five (5) years <br />after the expiration of this Agreement. After minimum holding periods are met, <br />Contractor will notify City ninety (90) days before destroying records. <br />Contractor agrees that the records of any and all companies conducting operations <br />addressed in the Agreement shall be provided or made available to City and its official <br />representatives during normal business hours. Account histories shall be accessible to <br />the City by computer for a minimum of five (5) years.
