8.3.6 Compilation of Information for State Law Purposes <br />Contractor shall maintain accurate records for its operation, including, but not limited <br />to, Solid Waste quantities Collected and quantities Transported to or Transferred to <br />each Approved or Designated Facility, listed separately by material type, Customer <br />type, and Facility. Records shall be maintained in such form by methods that facilitate <br />the use of data for the production of reports as needed. Contractor will make these <br />records available and provide to the City, or its designee, any record or documentation <br />necessary for the City to fulfill obligations under Applicable Law and regulations <br />including, but not limited to, AB 939, AB 341, AB 1826, AB 876, AB 901, AB 1594, SB <br />1383, and other current or future federal, State, or local regulations, as amended. <br />Contractor shall retain these records for a period of at least five (5) years after <br />termination of this Agreement. <br />8.4 Reporting Adverse Information <br />Contractor shall provide City two copies (one to the Executive Director, one to the City <br />Attorney) of all reports, pleadings, applications, notifications, Notices of Violation, <br />communications or other material relating specifically to Contractor's performance of <br />services pursuant to this Agreement, submitted by Contractor to, or received by <br />Contractor from, the United States or California Environmental Protection Agency, <br />CalRecycle, the Securities and Exchange Commission or any other federal, state or local <br />agency, including any federal or state court. Copies shall be submitted to City <br />simultaneously with Contractor's filing or submission of such matters with said <br />agencies. Contractor's routine correspondence to said agencies need not be routinely <br />submitted to City, but shall be made available to City promptly upon City's written <br />request. <br />8.5 Right to Inspect Records <br />City shall have the right to inspect or review the specific documents or records required <br />expressly or by inference pursuant to this Agreement, or any other similar records or <br />reports of Contractor or its related party entities that City shall deem, in its reasonable <br />discretion, necessary to evaluate annual reports, compensation applications provided <br />for in this Agreement and Contractor's performance provided for in this Agreement. <br />Contractor shall make all records and documents to be reviewed and inspected by the <br />City as a part of any audit or other record review conducted by the City, available for <br />August 17, 2021 137 City of Santa Ana <br />
