1. Collection Reliability <br />a) For each failure to commence service to a new Customer account within <br />seven (7) days after order, which exceeds five (5) such failures annually: <br />$100.00 per occurrence <br />b) For each failure to Collect Solid Waste, which has been properly set out for <br />Collection, from an established Customer account on the scheduled <br />Collection day and not Collected within the period described in this <br />Agreement which exceeds ten (10) such failures annually: <br />$100.00 per occurrence <br />c) For each failure to correct and collect a missed service the same day if <br />notified by noon, and by the next Collection if notified after noon:$100.00 per <br />occurrence <br />2. Collection Quality <br />a) For each occurrence of failure to properly return empty Containers to avoid <br />pedestrian or vehicular traffic impediments or to place Containers upright <br />which exceeds ten (10) such occurrences annually: $50.00 per occurrence <br />b) For each occurrence of excessive noise or discourteous behavior which <br />exceed ten (10) occurrences annually: $100.00 per occurrence <br />c) For each occurrence of Collecting Solid Waste during unauthorized hours <br />which exceeds ten (10) such occurrences annually: $100.00 per occurrence <br />d) For each occurrence of damage to private property which exceeds five (5) <br />such occurrences annually: $100.00 per occurrence <br />e) For each failure to clean up Solid Waste spilled from Solid Waste Containers <br />within ninety (90) minutes that exceeds ten (10) such failures annually: <br />$100.00 per occurrence <br />3. Customer Responsiveness <br />a) For each failure to initially respond to a Customer complaint within one (1) <br />business day (excluding Saturday, Sunday and holidays listed in Section <br />August 17, 2021 156 City of Santa Ana <br />
